NOTICE OF TRUSTEE’S SALE
NOTICE IS HEREBY GIVEN that, default having been
made in the payment of the indebtedness secured by
the deed of trust hereinafter described, and the
undersigned having been required so to do by the owner
and holder of said indebtedness, the undersigned
Substitute Trustee {see Substitute Trustee Book No. 12,
at page 536 thereof} will offer for sale at the front door of
the Tyler County Courthouse, Middlebourne,
West Virginia, on
FRIDAY, MARCH 27, 2020,
at 9:30 o’clock in the forenoon, local time,
at public auction, to the highest bidder for cash, all of
the right, title and interest of BERNARD L. TAYLOR,
JR., and DAWNA D. TAYLOR, husband and wife, in
and to the real property described in a certain deed of
trust dated April 25, 2006, to SISTERSVILLE
BANCORP, original Trustee, recorded in the Office of
the Clerk of the County Commission of Tyler County,
West Virginia, in General Lien Book No. 161, at page
438 thereof, possessed by the said BERNARD L.
TAYLOR, JR., and DAWNA D. TAYLOR as at the
making of said deed of trust, which real estate conveyed
by said maker is described therein as follows, to-wit:
FIRST: A parcel of land situate northeast of State
Secondary Route 64, approximately 0.3 miles south
from its intersection with Route 13, on the waters of
Indian Creek, in McElroy District of Tyler County, West
Virginia, more particularly bounded and described as
follows:
BEGINNING at a 5/8″ steel rod set at the eastern edge
of an old road, from which the eastern corner of a 6.777
acre tract of Bernard Taylor in the center of Route 64 is
N62*02’56″W 557.25 feet, thence
N43*27’42″E, a distance of 405.71 feet to a 5/8″ steel
rod set; thence
S17*45’15″E, a distance of 186.92 feet to a 5/8″ steel
rod set on the west bank of a run; thence
S06*22’21″E, a distance of 450.01 feet to a 5/8″ steel
rod set on the west bank of the run; thence
S46*47’02″W, a distance of 93.74 feet to a 5/8″ steel rod
set; thence
N65*14’16″W, a distance of 375.99 feet to a 5/8″ steel
rod set; thence
N56*17’38″W, a distance of 238.40 feet to a 5/8″ steel
rod set; thence
N64*39’07″E, a distance of 245.69 feet, passing the
center of a 20 foot right of way at 234.68 feet to the true
point of beginning. The above described parcel
contains 4.649 acres more or less.
Together with a non-exclusive Right of Way, more particularly described as follows:
A 20 foot right of way for ingress and egress from Route
64 to a 4.649 acre tract situate northeast of State
Secondary Route 64, approximately 0.3 miles south
from its intersection with Route 13, on the waters of
Indian Creek, in McElroy District of Tyler County, West
Virginia, the centerline being described as follows:
BEGINNING at a point in the northern line of the 4.649
acre tract surveyed out of a tract conveyed to W. Parker
in Deed Book 341 at page 54 and from which a 5/8″
steel rod set at the eastern edge of an old road is

N50*34’05″W, a distance of 106.83 feet; thence
N30*43’26″W, a distance of 169.25 feet; thence
N18*41’31″W, a distance of 52.19 feet; thence
N03*22’43″E, a distance of 106.60 feet; thence
N81*56’35″W, a distance of 76.65 feet; thence
N69*17’36″W, a distance of 66.23 feet; thence
N54*31’30″W, a distance of 81.93 feet; thence
N44*21’56″W, a distance of 152.70 feet; thence
N51*05’38″W, a distance of 88.67 feet; thence
N63*23’49″W, a distance of 71.40 feet; thence
N47*34’58″W, a distance of 102.77 feet to the center of Route 64.
Being the same property conveyed unto Bernard L.
Taylor, Jr., and Dawna D. Taylor by William H. Parker,
et al, by Deed dated January 12, 2006, and recorded in
the office of the Clerk of the County Commission of
Tyler County, West Virginia, in Deed Book No. 349 at
Page 634.
Subject, however, to all valid outstanding easements,
rights of way, mineral leases, mineral reservations and
mineral conveyances of record.
Upon information and belief, the Real Property or its a
dress is commonly known as
HC 62, Box 107, Lima, West Virginia 26377.
Upon the following terms to-wit:
1. Cash in hand on day of sale, or as the Trustee may
otherwise agree.
2. Minimum acceptable bid is $48,000.00. The sum of
$2,000.00 by Bank or Cashier’s check must be
delivered at the sale to the Trustee by the successful
bidder.
3. Subject to any and all reservations, exceptions,
conditions, grants of rights of way and easements made
by the grantors and their predecessors in title prior to
the granting of the deed of trust being foreclosed upon.
4. The undersigned reserves the right to adjourn the
sale from day to day and time to time upon oral
proclamation made at the time and place of sale set
forth herein or at such later time and place to which the
sale has theretofore been adjourned.
5. The undersigned reserves the right to reject any and
all bids.
6. Sale is subject to unpaid ad valorem taxes and
special assessments, if any, as well as any sale of the
subject real estate for unpaid taxes.
7. The premises described hereinabove, including any
and all improvements thereto, are sold “AS IS-WHERE
IS” with no warranty express or implied.
8. The owner and holder of the indebtedness secured by
the deed of trust described hereinabove reserves the
right to bid at this sale.
9. The successful buyer at the sale will be responsible
for paying any and all transfer stamps, excise fees and
recording costs with respect to the trustee’s deed.
10. Neither the owner and holder of the indebtedness
secured by the underlying deed of trust nor the
successor trustee shall have any duty to cause any
existing tenant or person or persons occupying the
subject property to vacate said property.
11. Any personal belongings remaining in the subject
premises after sale shall be deemed abandoned and
may thereafter be disposed of at the successful bidder’s
or bidders’ discretion. Any person or entity claiming
ownership of or any interest in any such property should
contact the undersigned prior to sale about any such
claim.
12. The successful bidder at the sale and the Trustee
shall execute a Memorandum of Sale at the conclusion
of the sale, and the terms of the Memorandum shall
control.
13. In the event that the successful bidder at the sale
fails or refuses to consummate his, her, its or their
purchase, then the Trustee shall have the option to
consummate sale with the next highest bidder at the
sale.
