UNDER DEED OF TRUST
Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Substitute Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on
May 13, 2020
11:00 a.m.
offer for sale certain property described in that certain deed of trust executed by LANAYA P. SHAFFER to Becky McClung and R. Mike Mullens, as Trustees, which deed of trust is dated the 5th day of July, 2017, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 558, at Page 730; and given to secure Mountain Valley Bank, N.A., the payment of a note therein described.
By Substitution of Trustee dated March 27, 2020, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 585, at Page 759, Jennifer L. Morgan was appointed Substitute Trustee, and which said property is described as follows:
All that certain tract or parcel of real estate being a part of Lot A-3 of the Tygart Valley Homesteads and located on the northeast side of Randolph Drive in the community of East Dailey, Valley Bend District, Randolph County, West Virginia, being more particularly bounded and described as follows:
Beginning at a point in the eastern boundary of Randolph Drive at a point in the center of a small drain, said point being a corner common to Lots A-4 and A-3 of the Tygart Valley Homesteads; thence leaving Randolph Drive with the line of Lot A-4 and along the small drain for two courses: S 47 56 E 59.40 feet to a point and S 54 14 E 147.59 feet to a point, said last point being referenced by a 5/8″ by 30 inch rebar driven at S 31 06 W 6.70 feet; thence leaving the small drain and the line of Lot A-4 going thru the parent tract of Lot A-3, S 31 06 W 65.40 feet to a 5/8″ by 30 inch rebar driven on the north side of the existing gravel driveway; thence continuing thru Lot A-3 following along the north of the gravel drive N 60 50 W 156.35 feet to a 5/8 inch by 30 inch rebar driven in the eastern boundary of Randolph Drive; thence with the eastern boundary of Randolph Drive N 05 08 E 82.71 feet to a brass capped concrete monument found; thence continuing with the eastern boundary of Randolph Drive N 02 15 W 23.50 feet to the point of beginning, containing 0.312 acres, more or less, as surveyed by William D. Swecker of Elkins, West Virginia, and as shown on a plat attached to deed of record in Deed Book 413, at page 265.
And being the same real estate conveyed to Lanaya P. Shaffer by Nathan W. Badgett by virtue of a deed dated July 5, 2017, and of record in the Office of the Clerk of the County Commission Randolph County, West Virginia, in Deed Book 588, at Page 102.
This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.
The above described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.
TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.
The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
