NOTICE OF SALE
UNDER DEED OF TRUST

Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Substitute Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

September 30, 2020
11:00 a.m.

offer for sale certain property described in that certain deed of trust executed by CHARLOTTE M. SUMMERFIELD to Jennifer Morgan, as Trustee, which deed of trust is dated the 7th day of April, 2017, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 557, at Page 318; and given to secure STATES RESOURCES CORP., the payment of a note therein described, and which said property is described as follows:

That certain tract or parcel of land being part of Lot Nos. 124 and part of Lot Nos. 123 of the Glenmore Acres Subdivision and is located on the east side of Gwendolyn Drive and more particularly bound and described as follows:

Beginning at an aluminum capped rebar found in the southern line of Gwendolyn Drive near Indianola Avenue, said point being a corner common to Brendan M. Slater (DB 424/77);

Thence with the southeast line of Gwendolyn Drive and Lot 126 N 07-27′ E 69.06 feet to a 3/4 inch by 30 inch rebar driven;

Thence leaving Gwendolyn Drive thru Lot 124 N 71-08′ E 87.51 feet to a 3/4 inch by 30 inch rebar driven in the line of Lot 127 now owned by Terry Jackson (DB 322/687);

Thence with the line of Lot 127 and Part of Lot 128 S 17-03′ E 62.00 feet to an aluminum capped rebar found at a corner common to Brendan M. Slater;

Thence with Slater line S 71-10′ W 116.18 feet to the point of beginning, containing 6,308 square feet, more or less, as surveyed by William D. Swecker of Elkins, West Virginia.

And being the same real estate conveyed to James Summerfield and Charlotte Summerfield, husband and wife, jointly with rights of survivorship, by DAYCON, Inc., by virtue of a deed dated September ___, 1994, and of record in the Office of the Clerk of the County Commission Randolph County, West Virginia, in Deed Book 435, at Page 249. James Summerfield subsequently died and pursuant to the survivorship clause contained in the aforesaid deed, title vested solely in Charlotte Summerfield.

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.

The above described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.

TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.

The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
