TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated July 18, 2016, and duly recorded in the Office of the Clerk of the County Commission of Harrison County, West Virginia, in Deed of Trust Book 1340, at Page 201, Heather Y. Hall did convey unto Larry F. Mazza and Richard A. Pill, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Harrison County Courthouse, in Clarksburg, West Virginia, on September 8, 2020 at 3:02 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Clark-Outside District, Harrison County, West Virginia, and more particularly described as follows: All that certain lot or parcel of land, situate in Windsor Hills Subdivision, in Clark District, Harrison County, West Virginia, known, numbered and designated as Lot No. Thirty-Six (36) of said Subdivision, as shown upon a plat of Windsor Hills Subdivision, which plat is of record in the Office of the Clerk of the County Commission of Harrison County, West Virginia, in Deed Book no. 1030, at Pages 758 through 762. The sewage facilities, streets, roads and street lighting in Windsor Hills Subdivision, are to be held and maintained by Windsor Hills Association, a corporation without capital stock, organized under the laws of the State of West Virginia for the purpose of holding and maintaining said sewer system, streets, roads and street lighting facilities in said Subdivision. The agreement of incorporation provides that membership in said Association, with the accompanying benefits to grantees and the obligations of grantees to pay certain charges and assessments shall be appurtenant to the lot or parcel of land hereby conveyed, and the grantee herein, by and upon their acceptance hereof, hereby covenants for themselves, their heirs and assigns, and as a covenant which will run with the land and be binding upon the grantees, their heirs and assigns, that they will fully perform and comply with the obligations and conditions of membership in said Association as set forth in said agreement in incorporation. Lots in Windsor Hills Subdivision shall be subject to, and the grantees herein, by and upon their acceptance hereof, expressly agree to be bound by the restrictions, conditions, rights, easements, reservations, exceptions and obligations of membership in Windsor Hills Association, a corporation, as set forth in that certain document entitled “Declaration of Protective Covenants and Reservations Pertaining to Lots in Windsor Hills Subdivision, Clark District, Harrison County, West Virginia”, of record in said County Clerk’s Office in Deed Book 1034, at Page 548, as if same we set out verbatim herein. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 152 Barnett Acres Road, Clarksburg, WV 26301. AND BEING the same real estate which was conveyed to Heather Y. Hall by Deed dated July 18, 2016, from Deloris K. Gorgonio, and recorded in the Office of the Clerk of the County Commission of Harrison County, West Virginia, in Deed Book, 1578 at Page 781. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
