NOTICE OF SALE OF MUNICIPAL PROPERTY
City of Elkins
Elkins, West Virginia 26241

Pursuant to West Virginia Code section 8-12-18(b), the City of Elkins hereby gives notice of the sale at public auction of those certain municipal properties described below at 10:00 a.m., Friday, November 13, 2020, at City Hall, 401 Davis Avenue, Elkins, West Virginia 26241. The properties will be sold as-is. The sale of the properties shall be subject to the requirement that all liabilities for any hazard associated with the premises shall be assumed by the purchaser. The sale of the properties will be made subject to all exceptions, reservations, rights-of-way, easements, conditions, covenants, restrictions and other servitudes of record, if any, pertaining to said properties, subject to all matters disclosed by an examination and inspections of the property, and to any further matters announced at said sale. There will be reserved from the sale of the properties any easements for a water and/or sewer lines on the property. The three municipal properties are described as follows:

PARCEL ONE

All that certain lot or parcel of land situate in the Park View Addition to the City of Elkins, designed as Lot No. 155 on the Plat of said Addition, which Plat is of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 81 at page 4, together with all improvements thereon, and bounded and described as follows:

Bounded on the North for 40 feet by Orchard Street, on the East for 120 feet by a 15-foot alley, on the South for 40 feet by a 15-foot alley and on the West for 120 feet by Lot No. 154.

PARCEL TWO

All that certain lot or parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate and being in Elkins Corp District, Randolph County, West Virginia, and described as follows:

Beginning at an alley between Graham and Davis Streets and extending westwardly along Second Street (now called Cherokee Street) with a uniform width of 43 feet to a distance of 30 feet toward Davis Street, and being the northeastern or rear portion of Lot No. 50, and a strip 30 feet long by 3 feet wide of the northeastern corner of Lot No. 51.

PARCEL THREE

A lot or parcel of land situate in the B. L. Hinkle Addition to the City of Elkins, at the intersection with Harrison Avenue and North Washington Avenue, at southeast corner of said intersection, about 450 feet north of the old Third Ward School building, Elkins Corporation, Randolph County, West Virginia, more particularly described as follows:

Beginning at a point at the southeast intersection of said Harrison Avenue with said N. Washington Avenue (DB 189 / 113 – Ref – DB 164/357), about 24 feet east of the center-line of the pavement of Harrison Avenue, set a 3/4″ x 42″ rebar with alum. cap, which is 3.1 feet south east of a street curb, from which the corner of a concrete wall, found, bears N 5 04 W, 155.98 feet, thence with the south boundary of said N. Washington Avenue.

N 52 49 E, 129.27 feet to a point in the south boundary of said N. Washington Avenue, at its intersection with an unopened 16 foot ally, set a 3/4″ x 42″ rebar with alum. cap, which is 4.3 feet southwest of a water valve, 3.8 feet northeast of a telephone junction box and 4.15 feet southeast of the street curb, from which a 4″ square concrete marker, found, bears N 49 47 E, 220.33 feet and the corner of the house bears S 22 42 W, 10.18 feet, thence with the west boundary of said unopened 16 foot ally.

S 8 30 E, 67.99 feet to a point in the west boundary of said 16 foot ally, an original corner to Lot #2 and Lot #3 of the B. L. Hinkle Addition (Plat Cabinet B, Slide 58) and a corner to Holland Real Estate (DB 363/489), set a 3/4″ x 42″ rebar with alum. cap, from which a 1/2″ iron pipe, found, bears S 8 30 E, 61.70 feet, a 4″ square stone marker, found, bears S 86 E, 267.48 feet and a telephone pole bears S 18 30 E, 25.65 feet, thence with said Holland Real Estate and a line between said Lot #2 and Lot #3.

S 81 30 W, 114.00 feet to a point in the east boundary of said Harrison Avenue, a corner to said Holland Real Estate and an original corner to Lot #2 and Lot #3 of said B. L. Hinkle addition, Set a 3/4″ x 42 ” rebar with alum. cap, from which a 1/2″ iron pipe, found, bears S 2 49 E, 60.00 feet, the northwest corner of a rock wall bears N 77 39 W, 3.9 feet and the corner of a house bears S 30 47 E, 31.05 feet, thence with the east boundary of said Harrison Avenue.

N 2 49 W, 5.97 feet to the beginning, containing 4,193.8 square feet or 0.10 acres, more or less, as surveyed in August, 1991, by a Leon G. Mallow, Professional Surveyor #567 and as shown on a plat of record in Deed Book 416 at page 243.

TERMS OF SALE: Sale will be awarded to the highest bidder. Cash or certified check in the amount equal to 10% of the bid price on the day of sale. Balance to be paid in full within 30 days from the date of sale. The City of Elkins reserves the right to reject any and all bids. The sale may be adjourned from time to time without further notice, other than oral proclamation at the time of the sale.
