NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE

Pursuant to the authority vested in the undersigned by deed of trust dated the 28th day of March, 2019, signed by Jamie Witek and Amanda Witek, husband and wife, to Judy Law Office, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 574, at page 150, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 1:00 o’clock, p.m. on the

8TH DAY OF DECEMBER 2020

at the front doors of the Courthouse in Randolph County, Elkins, West Virginia the following described real estate:

A tract or parcel of land situate on the south side of Old US Route 33 (Now Randolph County Route 11 – Ferguson Rd), at Crystal Springs, West Virginia, approximately 0.6 miles east of the intersection of present US Route 33 and State Route 92 and approximately 250 feet west of the intersection of the Gum Road (County Route 14) on the waters of Leading Creek, Leadsville District, Randolph County, West Virginia, more particularly described as follows:

Beginning at a set 3/4 inch by 36 inch rebar with a 2-3/4 inch diameter orange plastic cap, stamped L. Mallow PS 567 Property Corner (typical), on the right of way of said Old US Route 33, 20.4 feet from the centerline thereof, a corner to Roger L. Fortney reserved land (Deed Book 493 at page 151), from which a found 3/4 inch rebar, a corner to said Fortney, bears S 86 degrees 23′ W 85.06 feet, thence with the right of way of said road

N 86 degrees 23′ E 14.98 feet to a found 3/4 inch rebar on the right of way of said Old US Route 33, 20.3 feet from the centerline thereof, a corner to Jonathan H. Shiflet (Deed Book 590 at page 502) thence with said Shiflet

S 6 degrees 29′ E at 625.33 feet crossing a found 5/8 inch rebar, in all 629.08 feet to a set 3/4 inch by 42 inch rebar with a 2-3/4 inch diameter orange plastic cap, a corner in line of the remains of an old wire fence, a corner to said Shiflet and a corner in line of Terry Lee Ward (Deed Book 563 at page 602) thence with said Ward for two lines

N 85 degrees 27′ W, 122.20 feet to a found 3/4 inch rebar in a flat creek bottom area, thence

N 4 degrees 37′ W 235.93 feet to a set 3/4 inch by 42 inch rebar with a 2-3/4 inch diameter orange plastic, in a line of said Ward and a corner to said Fortney reserved land, thence though the parent Fortney tract of Deed Book 493 at page 151 for two lines.

N 85 degrees 28′ E 97.07 feet to a set 3/4 inch by 42 inch rebar with a 2-3/4 inch diameter orange plastic, thence

N 6 degrees 27′ W 373.95 feet to the beginning, containing 34,203 square feet or 0.78 acres, as surveyed in February 2019 by Leon G. Mallow of Leon G. Mallow Surveying Inc. a 2000 Piercy Rd Montrose WV; all bearings being grid north; as shown on a plat of survey attached hereto and made a part of this description.

Also conveyed is the following manufactured home: Manufacturer – CMH Manufacturing, Inc.; Model – 34TRA28523AH18; Length and width – 52 x 28; Serial Number – CAP031579TN – AB; New Used – New.

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

The above described real estate is reported to have a mailing address of: 626 Ferguson Road, Elkins WV 26241

To the knowledge of the Trustee this foreclosure sale is exempt from Coronavirus Pandemic restrictions for the following reason. Property is vacant or Investor is not a Governmental Entity. If any party has any knowledge to the contrary please contact the Trustee.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.

Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
