NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated April 16, 1998, executed by Borrower(s), Eugene D Taylor Jr., and Regina I Taylor, to Douglas C. McElwee, the Trustee of record in the office of the Clerk of the County Commission of Randolph County, West Virginia, in Book 288, at Page 8 and re-recorded in Book 302, Page 427. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 50 Darbey Dr., Mill Creek, WV 26280. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 12, 2021, of record in the Clerk’s Office in Book 598, Page 696. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Randolph County, in Elkins, West Virginia, on the following date:

April 15, 2021 at 4:30 P.M.

Situate in Huttonsville District, Randolph County, West Virginia, and being more particularly bounded and described as follows:
Beginning at a 5/8″ rebar set in a line common to Taylor, DB 383/593, on the western boundary of a Rock Drive on or near the southern bank of a small drain; S 33* 42′ 36″ W 126.95′ leaving said small drain and traveling with the southern boundary of said Rock Drive through Taylors 1.349 acre tract, DB 309/442, of which this is a part, to a 5/8″ rebar set in a line common to Taylor, WB 33/175. Said rebar bears N 63* 38′ 20″ W ± 278.0 ft. from the edge of County Route 46; thence N 63* 38′ 20″ E 137.44′ leaving said Rock Drive and traveling with a line or a portion of a line common to Taylor, WB 33/175, passing a 5/8″ rebar set at 120.03′, to a point on or near the eastern bank or Right Fork of Mill Creek; thence N 36* 08′ 16″ E 73.93′ traveling with or near the eastern bank of said Right Fork of Mill Creek, passing a 5/8″ rebar set at 60.07′. to a point in a line common to Taylor, DB 383/593, on or near the bank of said small drain; thence S 84* 14′ 26″ E 150.77′ leaving said Right Fork of Mill Creek and traveling with a line or a portion of a line common to Taylor, DB 383/593, traveling with or near said small drain, to the beginning.
Being the same property conveyed to Eugene D. Taylor. Jr. and Regina I. Taylor, husband and wife, by Deed dated the 9th day of April. 1998, and of record in the aforesaid Clerk’s Office in Deed Book 457 at Page 621. This deed is expressly made subject to all reservations, exceptions, rights of way or casements which affect the premises and the real estate hereby conveyed which are matters of record or which would be disclosed by an inspection and/or survey of the premises.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
