AUCTION BY
DEPARTMENT OF
TRANSPORTATION,
DIVISION OF HIGHWAYS
In accordance with provision of Chapter 17, Article 2A, Section 19, of the Official Code of West Virginia of 1931, as amended, the West Virginia Department of Transportation, Division of Highways (“Division”) hereby gives notice that it will offer for sale at public auction at 11 A.M., on April 21, 2021, the following parcel of real estate, at the site of the PARCEL, which is more particularly bounded and described as follows, to-wit:
BEGINNING at a point at the northwest corner of the Bridge at Williams Run, following West Virginia State Highway #2, N.3* 30′ E. 392 feet to an iron pipe at end of sewer; thence, N. 77* 30′ W.142.5 feet to an iron pipe, 16 feet West of a large beech; thence, N. 62* 30′ W. 115 feet to an iron pipe by a small W.C.; thence, N. 54* 30′ W. 192 feet to a stake at the Baltimore and Ohio Railroad right of way; thence, S. 8* 50′ W. 526 feet to a stake at the Baltimore and Ohio Railroad bridge at the edge of Williams Run, near the center pier of said bridge; thence, up Williams Run S. 81* 40′ E. 453 feet to the place of beginning, containing 4.25 acres.
There is EXCEPTED and RESERVED from this conveyance a parcel of property containing 0.457 acres conveyed to the City of New Martinsville by deed from Robinson Enterprises, a partnership to the City of Martinsville by deed dated May 13, 1988, and of record in the Wetzel County Clerk’s Office in Deed Book 325 at Page 84.
There is also EXCEPTED and RESERVED from this conveyance a parcel of property being 20′ by 30′ and an easement hereto, which was conveyed to the City of New Martinsville by deed from Webber Motors, Inc. dated July 14,1975, of record in Deed Book 282 at Page 154.
The tract of land for auction herein above described is all of the same real estate conveyed unto the Department by deed dated June 22, 2010, of record in the Office of the Clerk of the County Commission of Wetzel County, West Virginia, in Deed Book 422 at Page 853.
The parcel can be further identified and referenced by its District, Map and Parcel. It is situated in Wetzel County in the New Martinsville Corp. District on Map 10 as Parcel 7.1. This conveyance is made subject to existing utility rights of way, ease-ments, and lines, whether or not visible upon the ground.
This conveyance will be subject to all matters of record in the Office of the Clerk of the County Commission of Wetzel County, West Virginia.
The conveyance will be by Quitclaim Deed. The winning bidder, if any, will accept the conveyance on an “AS-IS,” “WHERE-IS” and “WITH ALL FAULTS” basis.
A Copy of the legal description plat of parcel, and Phase II Environmental Assessment Report are available for examination in the Office of the District Right of Way Agent, West Virginia Department of Transportation, Division of Highways, District 6 Headquarters, 1 DOT Drive, Moundsville, West Virginia, Monday through Friday between the hours of 7:30 AM and 4:00 PM. The information will also be onsite and available to bidders (30) minutes prior to auction.The auction will begin at11 A.M.The minimum opening bid is $800,000.00 and Ten Percent (10%) of the winning bid amount is due immediately upon completion of the auction, payable via a cashier’s or bank certified check. Department reserves the right to accept or reject any or all bids. Upon approval of the winning id, an executed deed will be forwarded to the relevant district office for closing of the transaction. The full winning bid amount must be paid in the form of a cashier’s or bank certified check made payable to the West Virginia Department of Transportation, Division of Highways, within (45) days after notification of approval. The deed executed by the Commissioner of Highways will be recorded in the appropriate county prior to forwarding to winning bidder. Department reserves the right to re-offer or reauction the property under similar terms if sale is not completed.
The West Virginia Department of Transportation, Division of Highways, in accordance with the provision of Regulations of the U.S. Department of Transportation (49 C.F.R., Part21) issued pursuant to the Civil Rights Act of 1964, hereby notifies all bidders that if a bid is accepted, it will affirmatively insure that the contract entered into pursuant to the advertisement will be awarded to the highest responsible bidder without discrimination on the grounds of race, religion, color, national origin, sex or disability.
The West Virginia Department of Transportation, Division of Highways further notifies all bidders that any instrument executed by the Department pursuant to this advertisement will contain provisions in compliance with the Civil Rights Act of 1964 (78 Stat. 252) and the regulations of the U.S. Department of Transportation (49 C.F.R., Part 21) issued pursuant to such act.
