NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 23, 1999, executed by Borrower(s), Charles C. Carr and Lona P. Carr, to Richard D. Guy, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 828, at Page 129. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 644 Madison Avenue, Parkersburg, WV 26101. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 1, 2021, of record in the Clerk’s Office in Book 2166, Page 602. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

ALL OF THOSE CERTAIN LOTS, TRACTS OR PARCELS OF LAND SITUATE IN THE CITY OF PARKERSBURG, COUNTY OF WOOD AND STATE OF WEST VIRGINIA, MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS:

FIRST TRACT: BEGINNING AT AN IRON STAKE, THE SAME BEING THE NORTHEAST CORNER OF LOT NO. 3 IN THE SOUTHEAST CORNER OF LOT NO. 4 IN T.R. PARK’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’S DIVISION OF JACKSON HEIGHTS.

SECOND TRACT: BEGINNING AT THE NORTHWEST CORNER OF LOT NO. 1 OF T.R. PARK’S SUBDIVISION, SAID POINT BEING IN THE OLD JACKSON LINE AND ALSO IN THE EASTERLY TERMINUS OF MADISON AVENUE, SAID POINT BEING ALSO THE SOUTHWEST CORNER OF LOT NO. 3 OF T.R. PARK’S SUBDIVISION; THENCE IN AN EASTERLY DIRECTION AND WITH THE COMMON LINE OF THE AFORESAID TRACT AND LOT NO. 3, 94 FEET TO A POINT; THENCE IN A SOUTHERLY DIRECTION AND WITH THE EASTERLY LINE OF THE AFORESAID TRACTTRACT 8.5 FEET MORE OR LESS, TO A POINT; THENCE IN A WESTERLY DIRECTION AND PARALLEL WITH FIRST LINE 94 FEET; MORE OR LESS, TO A POINT IN THE WESTERLY LINE OF THE AFORESAID TRACT; SAID POINT ALSO BEING IN THE OLD JACKSON LINE; THENCE IN A NORTHERLY DIRECTION AND WITH THE WESTERLY LINE OF THE AFORESAID TRACT AND THE OLD JACKSON LINE. 8.5 FEET TO THE PLACE OF BEGINNING.

THIRD TRACT: BEGINNING AT THE SOUTHWEST CORNER OF LOT NO. 4 PARK’S SUBDIVISION; THENCE NORTH 11.5 FEET; THENCE EAST 88 FEET; THENCE SOUTH 11.5 FEET TO THE SOUTHEAST CORNER OF LOT NO. 4; THENCE WEST 88 FEET TO THE SOUTHWEST CORNER OF LOT NO. 4, THE PLACE OF BEGINNIG.

THIS CONVEYANCE IS MADE SUBJECT TO ANY AND ALL EXCEPTIONS, AGREEMENTS, RESTRICTIONS, COVENANTS, EASEMENTS AND RIGHT OF WAY SET FORTH IN PRIOR DEEDS OF RECORD.

Being the same property conveyed to Charles C. Carr and Lona P. Carr by the Deed dated January 20, 1999 and recorded in Deed Book 993 at Page 590 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
