NOTICE OF SALE

Pursuant to the authority vested in me by Order of the Circuit Court of Randolph County, West Virginia, entered on the 29th day of August, 2018, in Civil Action No. 16-C-85. entitled COLANERO. et.als. v. COLANERO,et.als., as a Special Commissioner of said Court shall, on the 18th day of June, 2021, commencing at 10:00 a.m., proceed to sell at the front door of the courthouse of Randolph County, West Virginia, at a public auction, to the higgest bidder, the following desrcibed real estate.

FIRST: That certain tract or parcel of real estate situate in the Town of Bemis, in Beverly District, Randolph County, West Virginia, more particularly bounded and described as follows:

A parcel of land fronting on the West side of the Bemis Road for a distance of 75 feet, and running in a western direction therefrom for a distance of 150 feet.

This real estate is entered upon the 2020 Land Books of Randolph County, West Virginia, in Beverly District, on Tax Map 2, as Parcel 61.13, as LOT 75 X 150 FT BEMIS.

SECOND: Those two certain lots or parcels of land situate in the Town of Bemis, in Beverly District, Randolph County, West Virginia, more particularly bounded and described as follows:

FIRST: Beginning at an iron stake situate on the west side of the Bemis Road, a corner to O. O. Schoolcraft, thence with the Schoolcraft line west 150 feet to a stake; thence leaving the Schoolcraft line north 50 feet to an iron stake; thence east and parallel with the first line 150 feet to a stake on said road; thence with the western line of said road south 50 feet to the place of beginning, containing 7500 square feet, more or less.

This real estate is entered upon the 2020 Land Books of Randolph County, West Virginia, in Beverly District, on Tax Map 2, as Parcel 61.6, as 7500 SQ FT BEMIS.

SECOND: Beginning at an iron stake situate on the West side of the Bemis Road, a corner to a lot owned by Lester Paul Hawkins; thence with the Hawkins line West 150 feet to a stake; thence leaving the Hawkins line North 25 feet to a stake; thence East and parallel with the first line 150 feet to a stake on said lot; thence with the Eastern line of said lot South 25 feet to the place of beginning, containing 3,750 square feet, more or less.

This real estate is entered upon the 2020 Land Books of Randolph County, West Virginia, in Beverly District, on Tax Map 2, as Parcel 61.8, as 3750 SQ FT BEMIS.

AND BEING the same tracts of real estate as were conveyed unto Philip J. Colanero, by Daniel E. Graham and Kathryn J. Graham, his wife, and Larry L. Graham and Janice M. Graham, his wife, by deed dated July 15, 1989, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 399, at page 53. The said Philip J. Colanero died testate and by virtue of his Last Will and Testament, of record in the aforesaid Clerk’s Office in Will Book 37, at page 570, the subject real estate was devised to his children, Philip J. Colanero, Jr., Paulette O’Conner, Thomas R. Colanero, Cathy A. Johnson, James M. Colanero, and Annette M. Davis. By deed dated September 15, 2015, of record in the aforesaid Clerk’s Office in Deed Book 575, at page 345, the said Philip J. Colanero, Jr., conveyed all his right, title and interest in and to the subject real estate to Melissa Colanero Huffman.

The sale shall be made without warranty, subject to all reservations, exceptions, covenants, restrictions, limitations, conditions, rights of way or easements, and other servitudes, if any, made, retained or otherwise created by deeds or other instruments constituting the record chain of title to the real estate aforesaid, subject always to all accrued and unpaid ad valorem taxes. This sale is being conducted without certification of title and will be made subject to any liens, judgments or other encumbrances of record. Anyone who is interested in purchasing the property should contact an independent attorney for a title examination, if they so desire.

This sale shall further be made subject to all necessary rights of way for ingress, egress, and regress, water/sewer, and utility service to the real estate.
Terms of sale: Cash in hand on date of sale or letter of certified funds available to close within thirty (30) days.
