LEGAL NOTICE
REQUEST FOR PROPOSALS FOR ACCOUNTANT AND
LEGAL SERVICES

The Mercer County Public Service District, Mercer County, West Virginia is in the process of obtaining professional services necessary to complete a proposed project to upgrade the current Matoaka sewer system with an extension into Lashmeet and the Lake Bottom area. The project will also include the development of a new wastewater treatment plant to serve this system. These services include accountant and project attorney.

The selected Accountant will provide accounting services to prepare Rule 42 Exhibit to accompany the IJDC application as well as the application for Certificate of Convenience and Necessity to the West Virginia Public Service Commission in addition to any other services needed in relation to the project. The Accountant will work closely with the project’s engineer, administrator and legal counsel.

The Project Attorney is an integral part of the project team and will provide general legal services as necessary during the development and construction of the project. Areas of practice include obtaining Certificate of Convenience from the West Virginia Public Service Commission, title work as necessary to obtain construction right-of-ways and parcels and review of all contract and related documents as necessary. The Project Attorney will work closely with the project administrator and the project engineer.

Procurement of said services shall be in accordance with 2 CFR 200.320 (d). These contracts will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the Mercer County Public Service District, price and other factors considered including familiarity and expertise with this type of project.

All those interested in being considered for this must submit a proposal detailing qualifications and staffing capabilities, related prior work experience, fee schedule and ability to complete work as needed on this project in a timely manner.

Attention is directed to the fact that the proposed project may be undertaken through funding sources including but not limited to the HUD/Community Development Block Grant, Appalachian Regional Commission (ARC) Grant Program, the Economic Development Administration (EDA), the West Virginia Department of Environmental Protection (WV DEP), the West Virginia Infrastructure and Jobs Development Council, and the State Revolving Loan Fund.

All work will be performed in accordance with the regulations issued by the funding agencies and the State of West Virginia appertaining thereto.

The selected firm will be required to comply with Title VI of the Civil Rights Act of 1964, Executive Order 11246, Section 109 of the Housing and Urban Development Act of 1974, Section 3 of the Housing and Urban Development Act of 1968, Conflict of Interest Statement and Access to Records provisions and all other requirements as they relate to HUD-funded projects.

The Mercer County Public Service District reserves the right to accept or reject any and/or all proposals. The Mercer County Public Service District also reserves the right to negotiate the fee for services.
