PUBLIC SERVICE COMMISSION OF WEST VIRGINIA CHARLESTON CASE NO. 25-0711-MC-TC FLY-BY-NITE DISPOSAL SERVICE, INC., and WHITECAP WASTE OF WEST VIRGINIA, INC. Joint Petition for approval of transfer of P.S.C. M.C. Certificate No. F-7275 (requested expedited treatment) NOTICE OF FILING On August 6, 2025, Fly-By-Nite Disposal Service, Inc. and Whitecap Waste Of West Virginia, Inc. filed a Joint Petition for the approval of the transfer of Fly-By-Nite Disposal's P.S.C. M.C. Certificate No. F-7275, which authorizes it to provide service in Raleigh County, to Whitecap Waste of West Virginia, Inc. Whitecap Waste of West Virginia, Inc's new tariff retains the distinct residential base rate charges contained in Fly-By-Nite Disposals previous tariff, but does include the following new incidental provisions which do not cause a revenue increase for Whitecap Waste of West Virginia, Inc.: 1. NEW CUSTOMER DEPOSIT: On all current billings not paid within thirty (30) days, ten percent (10%) delayed payment penalty will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where it is appropriate. 3. BULKY GOODS COLLECTION: This carrier will collect bulky goods from all of its residential customers on the next to the last full week of each month. Before this carrier collects an appliance that once contained Freon or other gases, the removal of which is required by environmental regulations, that appliance must be certified as being free of Freon or other such gases. This carrier will assess a residential household an additional charge of $15.00 per appliance if such certification is not made prior to the collection of that appliance by this carrier. 8. IDENTIFICATION STICKERS: Each customer is required to display an identification sticker, provided at the option of the carrier, as evidence of being an active customer. This sticker will be approximately 4-112 by 2-1/2 and colors will be changed periodically. Anyone desiring to protest or intervene should file a written protest or notice of intervention within ten days following the date of this publication unless otherwise modified by Commission order. If no protests are received. the Commission may waive formal hearing and render its decision on the application based on the evidence submitted with the application and the Commission's review thereof. Requests to intervene must comply with the Commission's rules on intervention set forth in the Commission's Rules of Practice and Procedure.
