NOTICE
On January 28, 2026, Breyers Ridge Farm and Waste Management, LLC filed an Application for a certificate of convenience and necessity to operate as a common carrier by motor vehicle in the transportation and rental of dumpsters in Morgan and Berkeley Counties. Subsequently, the Applicant amended its Application to exclude Berkeley County. The certificate language would read as follows:
To operate as a common carrier by motor vehicle in the transportation of solid waste using dumpster rental services from points and places in Morgan County, West Virginia to places of disposal.
Rates: 7 Days 10 Days Additional Days
15-Yard Dumpster $350 $400 $10/day
20-Yard Dumpster $450 $500 $10/day
Since the filing of the Application, protests and requests to intervene have been filed in the case. As such, an evidentiary hearing has been scheduled in this matter for August 13, 2026, at 10:00 a.m., at the Berkeley Springs-Morgan County Courthouse Annex, Magistrate Court, 77 Fairfax Street, Berkeley Springs, West Virginia.
Anyone desiring to protest or intervene should file a written protest or request for intervention within ten (10) days following the date of this publication, or may appear at the scheduled hearing to do so. Requests to intervene must comply with the Commission’s rules on intervention set forth in the Commission’s Rules of Practice and Procedure.
