NOTICE OF TRUSTEE SALE

Pursuant to the authority vested in the undersigned by Deed of Trust dated the 17th day of July, 2013, executed by Shannon D. Trail, unto Mike Day and Harold B. Wolfe, III, Trustees, which said Deed of Trust is ofrecord in the Office of the Clerk of the County Commission of Mercer County, West Virginia , in Trust Deed Book 1260 at Page 48, and the undersigned, Harold B. Wolfe, III, have been requested to do so by the beneficiary, and default having been made under the terms and conditions of said Deed of Trust, and the provision in said Deed of Trust concerning acceleration having been compiled with by the beneficiary and present holder of the Note, said Trustee will sell at public auction at 10:00 a.m. on the 21st day of March, 2019, at the front doors of the Courthouse of Mercer County, West Virginia, the following described property, to-wit:

all of that certain lot designated as Lot 55 of the Christian Fork Estates as shown on a Plat entitled “Map Showing Lot Lay-Out of Par. 160 T.M. 17 Christian Fork Estates, County Route 44/12, East River District, Mercer Co., WV Job No. 07207, Scale: l ” = 60′, Date: 4/12/99 Revisions: 1) Revised Lots and Water Line Phase II- 1/20/08 2/19/08 2/4/08 2/7/08′, said Plat recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 16434, and more fully bounded and described as follows:

Beginning at a point on the southern line of the 40′ street, said point being the northeastern comer of Lot 56; thence, with the southern line of said street, S. 76deg. 31′ 51″ E. 100 feet to a point; thence, with the southern line between Lot 54 and Lot 55, S. 13deg. 15′ 06″ W. 100 feet to a point; thence with the division line between Lot 52 and Lot 56, N. 76deg. 31′ 51″ W. 100 feet to a point; thence with the division line between Lot 56 and Lot 55, N. 13deg. 15′ 06″ E. 100 feet to the place of the Beginning.

The party of the first part further conveys unto the party of the second part a right of-way for ingress and egress along the streets shown on the aforementioned plat of survey.

This deed is made subject to a Declaration of Protective Covenants, Restrictions and Reservations for Christian Fork Estates of record in said Clerk’s Office in Deed Book 844 at Page 712, and easements set forth on said plat.

This conveyance is expressly made subject to and benefitted by all covenants, restrictions, reservations, conditions, easements and rights-of-way of record.

This conveyance is expressly made subject to the easement for sewer line as shown upon Map.

This conveyance is made expressly subject to all pertinent restrictions, reservations and easements of record.

And being the same property conveyed unto Shann.on D. Trail from BRET, Inc., by deed dated the 11th day of June, 2013, ofrecord in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 993 at Page 395.

It is the intention of this Notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust.

The above described real estate is reported to have a physical address at 397 Overton Circle, Princeton, Mercer County, West Virginia, 24740.

This sale will also be made subject to any and easements heretofore granted by predecessors in title; and subject further to any and all unpaid real property taxes and lnpaid assessments, the purchaser assuming payment thereof.

The owners and holders of said Note reserving the right to enter a bid at said sale and the right t0 reject any and all bids.

The Trustee reserves the right to reject any and all bids.

TERMS OF SALE: Cash in hand on the day of sale, or upon terms to be agreed upon between Trustee and successful bidder; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title to this property.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a Notice of same where legal notices are posted for this county. Should the Trustee not appear at the time appointed for the sale and there is no Notice posted of a continlance, please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated gent to sell said property as Trustee by instrument to be recorded.
