The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 1, 2006, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed of Trust Book 1093, at Page 647, Sheila L. Belcher did convey unto Mike Day and Douglas E. Hayes, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse, in Princeton, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows:

Lot 19 of Northview Estates as shown on the map entitled “Map Showing Subdivision of Part Parcel 74, Tax Map 12, Off State Route 20 Beaver Pond Dist., Mercer Co., WV” made by Appalachian Engineering & Surveying, in. dated 8/5/97 rev. 5/10/99 of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat Record No. 13813, and which said parcel is further described as follows:

BEGINNING at a roof bolt in the centerline of a 30′ wide road right-of-way running through Northview Estates, said roof bolt being the southeast corner of Lot 20 and the northeast corner of the herein described tract; thence along said centerline and the western line of Lot 27 for the following two calls: S 30deg. 38′ 04″ W. 97.65′ to a point; S 36deg. 18″ 18′ W. 23.38′ to a roof bolt; thence continuing along the western line of Lot 27 and along the eastern line of a 30′ wide road right-of-way running through Northview Estates S 00deg. 57′ 32″ W. 53.27′ to an iron bar; thence along the northwest line of Lot 32 S 27deg. 26′ 44″ W 271.68′ to an I.P., said I.P. being the northernmost corner of Lot 14; thence along the eastern line of Lot 18 N 07deg. 15′ 53″ E 353.39′ to an iron bar in the northern line of a 30′ right-of-way running through Northview Estates, said iron bar also being the northeast corner of Lot 18; thence through Parcel 74 Tax Map 12 N 07deg. 15′ 53″ E. 109.24′ to an iron bar; thence along the southern line of Lot 20 S 64deg. 48′ 59″ E 144.99′ to the point of BEGINNING and containing 32.377 square feet more or less, or 0.74 acre more or less.

This tract is subject to a 30′ wide road right-of-way which runs though said Lot 19 and along the southeast line of Lot 19 for ingress and egress to other lots. This tract is further subject to the portion of a 30′ wide road right-of-way which also runs along the northeast line of this lot.

This conveyance is subject to those Declaration of Protective Covenants of record in said Clerk’s Office in Deed Book 796 at Page 157.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 19 Sportsman Drive , Northview Estates, Bluefield, WV 24701.

AND BEING the same real estate which was conveyed to Sheila L. Belcher by Deed dated September 4, 2002, from Willis E. Bishop and Mary Ann Bishop, and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 848, at Page 68.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
