SPECIAL COMMISSIONER’S SALE OF VALUABLE REAL ESTATE

By virtue of the authority vested in your undersigned Special Commissioner by that certain Order entered in the Circuit Court of Hardy County, West Virginia, dated the 14th day of September, 2017 in Civil Action Number 17-C-28 styled Jennifer Anne See, et. als. Plaintiffs, versus Peggy Riggleman, et. als. Defendants, your undersigned Special Commissioner will offer for sale at public auction to the highest bidder or bidders at the front door of the Courthouse in Moorefield, Hardy County, West Virginia on SATURDAY, November 11, 2017
AT 12-noon

The following tracts or parcels of real estate lying and being situate in Moorefield Corporation, Hardy County, West Virginia as follows:

1. Parcel 5 of Map 12 of Moorefield Corporation District, Hardy County, West Virginia, containing 5.322 acres, more or less, and is directly adjacent to the Mountain View Addition to the Town of Moorefield subdivision; however, the said aforementioned tract or parcel of real estate IS NOT SUBJECT to the Covenants of the Mountain View addition to the Town of Moorefield subdivision.

2. Parcel 16 of Map 12, Moorefield Corporation District, Hardy County, West Virginia containing 0.33 acres, more or less, and is situate within the Mountain View Addition to the Town of Moorefield subdivision and the said aforementioned tract or parcel of real estate IS SUBJECT to the Covenants of the Mountain View Addition to the Town of Moorefield subdivision.

3. Parcel 73 of Map 12, Moorefield Corporation District, Hardy County, West Virginia being a strip of land approximately thirty (30’) feet by one hundred thirty-four point zero four (134.04’) feet; and is located within the Mountain View Addition to the Town of Moorefield subdivision and the said aforementioned tract or parcel of real estate IS SUBJECT to the Covenants of the Mountain View Addition to the Town of Moorefield subdivision.

4. Parcel 74 of Map 12, Moorefield Corporation District, Hardy County, West Virginia being a strip of land approximately thirty (30’) feet by one hundred thirty-four point zero four (134.04’) feet; and is located within the Mountain View Addition to the Town of Moorefield subdivision and the said aforementioned tract or parcel of real estate IS SUBJECT to the Covenants of the Mountain View Addition to the Town of Moorefield subdivision.

All of the above tracts or parcels of real estate will be offered for sale separately and will not be combined.

Tract Two (2), Three (3) and Four (4) will be conveyed subject to those certain covenants applicable to Mountain View Addition to the Town of Moorefield subdivision which said covenants are of record in the Office of the Clerk of the County Commission of Hardy County, West Virginia in Deed Book 186, at Page 770. Said covenants will be incorporated into the Deed or Deeds to the high bidder or bidders as it would relate to tracts Two (2), Three (3) and Four (4). The Plat of Survey of said subdivision is of record in the aforesaid Clerk’s Office in Plat Book 3, at Page 63.

The four (4) tracts or parcels of real estate constitute the entirety of the residue of that certain tract or parcel of real estate originally containing 27.38 acres, more or less, as set forth in that certain Deed of record in the Office of the Clerk of the County Commission of Hardy County, West Virginia in Deed Book 168, at Page 131.

Real estate taxes that become due to and through the fall of 2017 will be paid by your undersigned Special Commissioner. Real estate taxes that become due in the spring of 2017 and henceforth shall be paid by the Purchaser or Purchasers of the respective tracts.

Your undersigned Special Commissioner will pay the excise tax on the privilege of real estate transfers in the State of West Virginia and will also pay for the cost of the preparation of the Deed or Deeds conveying the above referenced real estate to the highest bidder or bidders.

Sale of each and every tract of real estate being offered for sale is subject to confirmation by the Circuit Court of Hardy County, West Virginia.

Each of the tracts or parcels of real estate will be conveyed to the highest bidder or bidders by Special Warranty Deed from your undersigned Special Commissioner.

TERMS: A ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) deposit per tract, by cash, cashier’s check, or acceptable check is required on day of sale with the balance to be paid within twenty (20) days upon notice to the high bidder or bidders of confirmation by the Circuit Court of Hardy County, West Virginia which said confirmation will be sought by your undersigned Special Commissioner in an expeditions manner.
