The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 31, 2013, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Document No. 201400000009, in Book No. 1075, at Page 473, Deon C. Waites did convey unto John S. Burson, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated March 18, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by North American Savings Bank F.S.B. to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse in Fairmont, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in FMT City Grant Annex District, Marion County, West Virginia, and more particularly described as follows:
All that certain parcel of land, together with the improvements thereon and the appurtenances thereunto belonging situate in Newcome Addition, Section III, Revised, in the City of Fairmont, Grant District, Marion County, West Virginia, a map or plat of which is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book 810, Page 1014, described as follows:
LOT NUMBER NINE (9), SECTION III, REVISED, NEWCOME ADDITION:
Beginning at a stake in line of Kennywood Drive, the northeast corner of Lot No. 2, Section 1, and thence with a line thereof and extending further, S. 28 degrees 18′ W. 229.69 feet to a stake in an original line of the Newcome property; thence with the same. S. 58 degrees 57′ E. 105.13 feet to a stake, corner of Lot No. 11, Section III; thence with a line of the same, N. 28 degrees 18′ E. 53.67 feet to a stake; thence with a line through Lot No. 9, Section 111 (creating Lot No. 9 Section III, Revised), N. 28 degrees 31′ E. 150.38 feet to a stake in line of Kennywood Drive; thence with Kennywood Drive, N. 45 degrees 30′ W. 110.00 feet to the place of beginning, containing 0.5355 of an acre, more or less.
Being the same real estate conveyed to Deon C. Waites, from David N. Ware or Barbara A. Ware, by that certain deed dated December 31, 2013, and to be recorded simultaneously herewith.
This conveyance is further subject to all exceptions, reservations, rights of way, conditions, and agreements contained in prior deeds or other instruments in the chain of title to said real estate, or to such of the same as are now in full force and effect and legally enforceable.
At the time of the execution of the Deed of Trust, this property was reported to have an address of:
406 Kennywood Drive, Fairmont, WV 26554.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
