OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee will, by virtue of authority vested in him by that certain Trust Deed dated May 22, 2008 by and between DAVID M. HEDRICK to Becky Sue Judy and Caton N. Hill, Jr., Trustees, securing Farm Credit of the Virginias, ACA, in the payment of a certain Promissory Note, said Note now in default, and said Trust Deed of record in the Office of the Clerk of the County Court of Tucker County, West Virginia, in Trust Deed Book 232 at page 68, on
Friday, January 29, 2021
beginning at 11:30 AM, of that day at the Second Street entrance to the old Tucker County Courthouse, Parsons, West Virginia, offer for sale at Public Auction to the highest bidder the following described real estate:
All of that certain tract or parcel of real estate, together with any and all improvements, rights of ways and appurtenances thereunto belonging, lying and situate in Black Fork District, Tucker County, West Virginia, and being more particularly bounded and described as follows:
First Parcel: “Beginning at a large chestnut stump, standing on the east side of State Road, the same being also a comer to lands of Frank Ferguson, and running thence with two lines of Ferguson S, 82° E. 45 poles, to a small maple by locust post, thence S. 77° E. 65 poles to locust post in a wire fence, comer to Ferguson, Parsons and Maxwell, thence with Melville Parsons line along an Old wire fence, S. 61 ° E. 80 poles to a locust post, standing in Abraham Dumire’s line, thence with a part of said Dumire’s line S. 78° W. 158 poles to a small white oak standing on the east side of the State Road, thence with the eastern side of State Road N. 4° E. 18-1/2 poles, N. 30° W, 18 poles, N. 12” 30’ W. 24 poles to where a small white oak formerly stood, a corner to Ferguson’s bottom tract, containing 61-1/4 acres, exclusive of the Presbyterian Church Lot, said to contain 1-1/4 acre.”
Second Parcel:”Beginning at a large chestnut tree standing on the river bank, a corner to the said 130 acre tract and also a corner of Wamsley’s land running thence up the river bank, S. 30 1/2 E. 23 poles to red oak; thence 77 1/2 E. 156 poles through the tract to a stone between two small oaks at the lower edge of the road; thence N. 13 1/2 W. 23 1/2 poles to a white oak to corner to the whole tract and also a corner to Wamsley’s Tract; thence with Wamsley’s line being also a northern line, with the whole tract S. 77 ½ W. 163 poles to the beginning, containing twenty-one (21) acres and three (3) rods and thirty-one (31) poles.”
Third Parcel: “Beginning at an oak on the river bank second corner to Lot No. 1 and running thence up the river S. 30 ¾ E. 23 poles to a poplar; thence through the tract N. 77 ½ E. 159 poles to a stone (16) at the upper bank of the road; thence with the road N. 28 ¼ W. 11 poles; thence N 38 ½ W. at still with the road 11 poles to point in the road opposite to large chestnuts standing below the road; thence N. 13 ½ W. 1 2/3 poles to a stone between two small oaks-bushes being the third corner of Lot No. 1; thence 21 acres, two rods and fourteen poles; thence with the second line of Lot No. 1, S. 77 ½ W. 151 poles to the beginning, containing 21 acres, two rods and fourteen poles.”
Fourth Parcel: A strip of land 8 feet wide extending the entire length of last line of Second Parcel.
First, Second, Third and Fourth Parcels were conveyed to Hugh D. Dumire, Eva M. Dumire and David M. Hedrick, as joint tenants with rights of survivorship, by Pat A. Nichols, Trustee, by deed bearing date of March 5, 1981, and of record in Deed Book No. 98 at page 3; and Hugh G. Dumire died on May 5, 1985, and Eva M. Dumire and David M. Hedrick became the sole owners of the real estate as the surviving joint tenants; and Eva M. Dumire died on July 28, 1992, and David M. Hedrick became the sole owner of the real state as the surviving joint tenant.
The real estate is assessed on the 2020 Tucker County Land Records in Black Fork District on Tax Map 263, Parcel 2 and Tax Map 264, Parcel 2.
Reference is hereby made to all instruments in the chain of title for any and all pertinent purposes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Substitute Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
Said Substitute Trustee was duly appointed by instrument dated August 27, 2020, and of record in the Tucker County Clerk’s Office in Trust Deed Book 300 at page 63.
TERMS OF SALE
$10,000.00 on day of sale and balance upon closing, not to exceed thirty days. Announcements made at sale take precedence over any written notice or advertisement.
