TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 20, 2003, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2003507671, in Book No. 00692, at Page 00111, Corwin Brent Myers and Rachel Rene Myers did convey unto Tommy J Dixon, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated June 26, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on August 20, 2015 at 11:00 a.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Plateau District, Fayette County, West Virginia, and more particularly described as follows: THE FOLLOWING DESCRIBED TRACT OR PARCEL OF SURFACE LAND, TOGETHER WITH THE IMPROVEMENTS THEREON, APPURTENANCES THEREUNTO BELONGING AND RIGHTS INCIDENTAL THERETO, SITUATE NEAR GARTEN, PLATEAU DISTRICT, FAYETTE COUNTY, WEST VIRGINIA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO WIT: BEGINNING AT AN IRON RID, BEING A CORNER WITH THE PLEASANT VIEW CEMETERY ADDITION, AND SAID ROD BEING 15 FEET FROM THE CENTERLINE OF SECONDARY ROAD 12, THENCE RUNNING WITH SECONDARY ROUTE 12 (WOLF CREEK ROAD) N 35 14′ W 129.55 FEET TO A STAKE BEING 15 FEET FROM THE CENTER LINE OF THE ROAD, THENCE CONTINUING WITH THE ROAD 15 FEET FROM THE CENTER LINE OF THE ROAD, THENCE LEAVING THE ROAD N 59 12′ E 208 FEET TO A 1 INCH IRON ROD, THENCE S 30 48′ E 170.65 FEET TO A 1 INCH IRON ROD, SAID ROD BEING N 48 47′ E 15 FEET FROM THE NORTHERNMOST CORNER OF THE CEMETERY, THENCE S 48 47′ W 204.1 FEET TO THE BEGINNING AND CONTAINING 0.90 ACRES, ALL BEARINGS BEING AS OF THE MAGNETIC NORTH, JANUARY, 1978, AND AS SURVEYED BY EDWARD WOJTOWICZ, C.E. 6756. TAX MAP OR PARCEL ID NO.: 8-17 At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1052 Pleasant View Road, Fayetteville, WV 25840. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
