NOTICE OF TRUSTEE’S SALE
Under authority of that certain Deed of Trust dated August 22, 2013 from Charles K. Phillips, aka Charles Phillips, and Paula I. Phillips, aka Paula Phillips, to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Tucker County, West Virginia in Trust Deed Book No. 264, at page 522, securing a promissory note in the principal amount of $66,852.31, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Tucker County Courthouse in Parsons, West Virginia, on April 28, 2021 at 11:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, the following two (2) pieces or parcels of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate in the Town of Hendricks, Tucker County, West Virginia, described as follows, to-wit:
PARCEL ONE: Beginning at the Jeff Fraley N.E. corner on
which his building stood, thence with his line S. 18 W. about
30 feet to the right of way of the now Western Maryland
Railway Company, thence with the right of way of said road
westerly to the west side of the first big run known as the
school house run, thence up the west side of said run with
the meanders so as to include the water to a point where the
grantors western line of Jacob Woodruff’s one acre lot
intersects said run, thence from this point with the center of
said run with the meanders to George Allender’s northwest
corner in said run as sold to him by J. W. Bowman, thence
with Allender’s line N. 39 E.180 feet to the line of North
Street, thence with said street line S. 56 W. 250 feet and if
North Street is ever discontinued, said street is to fall to the
parties of the second part, mentioned in this deed, crossing
the end of Main Street to the South side street line, thence
with the south line of Main Street S. 72 E. 125 feet to the
beginning, containing about 3.26 acres, more or less.
The above parcel of real estate is subject to an outsale of
5,760 square feet to Junior Harper and Evelyn Harper,
husband and wife, by deed dated November 6, 1997 and of
record in the said Clerk’s Office in Deed Book No. 157 at
page 187 and to an outsale to Dale K. Hedrick and Frances
M. Hedrick, husband and wife, containing 32, 7670 square
feet or 314 of an acre, more or, less, bearing date of May 8,
1980 and of record in Deed Book No. 96 at page 340. This
leaves a balance of 2.51 acres, more or less, in the above
described parcel.
PARCEL TWO: Beginning at the Jeff Fraley N.E. corner on
which his building stood, thence with his line S. 18 W. about
230 feet to the right of way of the now Western Maryland
Railway Company, thence with the right of way of said road,
westerly about 150 feet to an iron stake in right of way,
thence N. 18 E. about 230 feet crossing the end of main
street to the south side street line, thence with the south line
of main street S. 72 E. 150 feet to the beginning, containing
about 314 acre or 32.670 square feet.
Being the same property conveyed from Dale K. Hedrick and Frances M. Hedrick, husband and wife, to Charles Phillips and Paula Phillips, husband and wife, by Deed dated May 20, 2010, of record in the aforesaid Clerk’s office in Deed Book No. 200, at page 348.
Terms of sale: Ten percent nonrefundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
