The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated December 2, 1997, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Microfilm Roll 124, at Slide 1846, Early Henderson did convey unto Frank S. Harkins, Jr., Ottice R. Adkins, and Alan H. Larrick, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on
April 2, 2019, at 1:40 p.m.
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Mabscott District, Raleigh County, West Virginia, and more particularly described as follows:
The surface of Lot Twenty-Three (23) of Mabscott Heights Addition to the City of Mabscott, Municipal District, Raleigh County, West Virginia, as shown on a map thereof record in the Office of Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 8, at page 91, which said lot fronts 72.30 feet on Eastwood Avenue and extends back therefrom with the line of Lot 25 a distance of 121 feet to an alley and extends back on the opposite side with Lot 21 a distance of 121 feet to said alley, bordering thereon 71.60 feet.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 131 South Hill Street, Mabscott, WV 25871.
AND BEING the same real estate which was conveyed to Early Henderson by Deed dated December 1, 1997, from M. Valerie Persinger, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Microfilm Roll 124 at Slide 1912.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
