TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 7, 2011, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50419394, in Book No. 5041, at Page 9394 and modified in Document No. 50575681, in Book No. 5057, at Page 5681, Patrick Lee Dillon and Mandy S. Dillon did convey unto Vance Golden, Attorney, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 14, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on August 27, 2015 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Clear Fork District, Raleigh County, West Virginia, and more particularly described as follows: The following described tract or parcel of land, together with all appurtenances thereunto belonging, bounded and described as follows: SITUATE on the waters of Clear Fork of Coal River in Clear Fork District of Raleigh County of West Virginia, near the Mouth of Buggards Branch, said parcel or lot being at an iron stake driven on the ground at corner of Roy Flints property ninety-one (91) feet west of Buggards Branch; thence running northeast One Hundred Eighty Three (183) feet to an iron peg driven and thence in a northwesterly direction One Hundred Fifty Two (152) feet to an apple tree; thence in a southwesterly direction to the County Road One Hundred Ninety Eight (198) feet; thence in a southeasterly direction along the County Road the place of Beginning, One Hundred Sixty Seven (167) feet. And being the same property acquired by Patrick L. Dillon and Mandy Dillon, husband and wife, by deed dated January 5, 2011, from James Howell and Crystal Howell, husband and wife, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 8182 Clear Fork Road, Dorothy, WV 25060. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
