TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 26, 2007, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50299234, in Book No. 5029, at Page 9234, Stacy L. Cooley and William J. Cooley did convey unto Richard A. Pill, ESQ, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated December 30, 2014 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on February 12, 2015 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in City of Beckley District, Raleigh County, West Virginia, and more particularly described as follows: The surface of that certain real estate located in CITY OF BECKLEY DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, and more particularly described as follows: BEING that certain property located in the City of Beckley, Raleigh County, West Virginia, being LOT NO. TWENTY-ONE (21) of the EXTENSION OF ELLISON ADDITION as shown on a map of the same of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 3 at page 34-B, bounded and described as follows: BEGINNING at a stake in the western line of William Street (now Lilly Street), the common corner between lot herein conveyed and Lot 20; thence with the common line of Lots 20 and 21, N. 79 degrees 27′ W. 150 feet to a stake in the eastern line of a 10 foot alley, the common corner of Lots 20 and 21; thence with the aforesaid eastern line of said alley S. 10 degrees 33′ W. 60 feet to a stake common corner of Lots 21 and 22; thence with the common line of said lots S. 79 degrees 27′ E. 150 feet to a stake in the aforesaid western line of Lilly Street N. 10 degrees 33′ E. 60 feet to the point of BEGINNING, containing 9,000 square feet. And being the same property acquired by William J. Cooley and Stacy L. Cooley by deed dated June 28, 2005 from Susan L. Daniels, fka Susan L. Hartsock, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5018, at page 3460. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 104 Lilly Street, Beckley, WV 25801. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
