TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 10, 2007, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2007509550, in Book No. 807, at Page 733 and modified in Document No. 2015000853, in Book No. 943, at Page 697, Anita K. Clay did convey unto Richard A. Pill or David D. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated June 25, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Bank of America, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on October 22, 2015 at 11:00 a.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Oak Hill District, Fayette County, West Virginia, and more particularly described as follows: That certain tract or parcel of surface real estate situate in the City of Oak Hill, Fayette County, West Virginia, in the “Sunrise Addition of the Oak Hill Investment Company”, as shown in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Map Book 5, at page 50, to which reference is here made, together with the right to use in common with the other owners of lots the streets, alleys and ways as shown thereon; the said parcel being described as follows: to-wit: BEGINNING at a point, corner to Lots 6 and 7 and Lots 23 and 28; thence running with Lots 23 and 24, S. 35 f 49′ W. 164 feet to a stake; thence running with the property line of Lots Nos. 24 and 25, S. 53 f 54′ E. 75 feet to a stake; thence leaving said stake and running N. 35 f 49′ E. 164 feet to a stake; thence leaving said stake and running N. 53 f 54′ W. 75 feet to the point of beginning. And being the same property heretofore acquired by Steve D. Clay and Anita Kay Clay, his wife, herein from Shara Lee Jenkins, by Deed dated the 14th day of May, 1998 and of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 549, at page 364; the said Steve D. Clay having died July 7, 2004 leaving Anita Kay Clay as the surviving joint tenant. And the following property: Lot Nos. 23 and 24 of the “Sunrise Addition of the Oak Hill Investment Company”, as said lots are shown on a certain map of said Addition which is of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Map Book 5 at page 50, to which reference is here made, together with the right to use in common with the other owners of lots the streets, alleys and ways as shown thereon. But EXCEPTING and RESERVING therefrom the portion of said real estate conveyed to D. L. George Jenkins by deed of James E. Elder and Margaret Elder, dated September 24, 1979, and of record in the aforesaid Clerk’s Office in Deed Book 383 at page 611. And being the same property conveyed to the party of the first part from James E. Elder by deed dated the 30th day of May, 1986, which deed is of record in the aforesaid Clerk’s Office in Deed Book 443, at Page 166. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 100 Rakes Street, Oak Hill, WV 25901. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
