TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated February 28, 2005, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50169622, in Book No. 5016, at Page 9622, Jason W. Bailey and Janice M. Bailey did convey unto Richard A. Pill, Esq., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 6, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on December 10, 2015 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Trap Hill District, Raleigh County, West Virginia, and more particularly described as follows: Those certain lots or parcels of land situ in Trap Hill District, Raleigh County, West Virginia, and more particularly being Lots Nos. 52 and 53 of “Hedrick Homesteads”, as shown on map entitled ‘PROPERTY OF CHARLES R. & DEBRA BOWYER, HEDRICK HOMESTEAD LOTS 52, 53 AND 20′ R/W (P/O LOT 54), HARPER, TRAP HILL DIST., RALEIGH COUNTY, WEST VIRGINIA, DATE: 3-13-80, SCALE: 1″ = 50′,prepared by GO. BLEDSOE, INC. “a copy of which map is attached hereto and made a part of this description, and more particularly bounded and described follows: BEGINNING at a set bolt in the common line of Hedrick Homesteads and Eccles Truck Farms and being the common northern corner of Lots 53 and 54; thence with said line N. 40 f 35′ E. 102.00 feet to a set bolt, being the common northern corner of Lots 52 and 51; thence with the common lot line between Lot 51 and 52 S. 49′ 25′ F. 330.00 feet to a set bolt, said bolt being on the northern right of way line of Circle View Drive; thence with said right of way the following two calls: S. 22 f 29′ W. 54.71 feet to a set bolt; S. 23′ 53′ W. 52.20 feet to a set railroad spike; thence leaving said right of way and with the original lot line between Lots 53 and 54 N. 49ยท 25’ W. 362.00 feet to the point and place of beginning, and containing 0.81 acres. more or less. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
