TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 15, 2007, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50294494, in Book No. 5029, at Page 4494 and modified in Document No. 50420094, in Book No. 5042, at Page 0094, Roger D. Martin, Jr. and Belinda Martin did convey unto BB&T Collateral Service Corporation, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 26, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by FV-I, Inc. in Trust for Morgan Stanley Mortgage Capital Holdings LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on January 28, 2016 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Lester District, Raleigh County, West Virginia, and more particularly described as follows: TRACT 1: The surface, together with any appurtenances thereon, a certain realty situated within the municipality of Lester, in Trap Hill District, Raleigh County, West Virginia, and bounded and described as follows: Being LOTS NOS. 13, 14, & 15 in ARTHUR HEIGHTS ADDITION to said City, as the same appear on a map entitled “Plat of Arthur Heights, Town of Lester, Raleigh County, West Virginia”, recorded in Map Book 3-8B in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, (see also the Assessor’s Tax Map, entitled “Lester Corporation, District 3, Map No. 3, parcel 24, showing said Lots Nos. 13, 14 & 15). TRACT 2: The real estate situate in the Town of Lester, Raleigh County, West Virginia, and bounded and described as follows: The following described lots or parcels of surface land, together with all the appurtenances thereunto belonging or in anywise appertaining, to-wit: LOTS NOS. 16, 17, 18, and 19 in ARTHUR HEIGHTS ADDITION to the Town of Lester, Raleigh County, West Virginia. TRACT 3: The certain real estate situate in the Town of Lester, Raleigh County, West Virginia, described as follows: LOT 20 LESTER ARTHUR HEIGHTS ADD, and more particularly bounded and described as follows: The surface of the following described lot or parcel of land situate in the Town of Lester, Trap Hill District, Raleigh County, West Virginia, and being Lot 20, as shown on a map made by F.A. Cloud, September 24, 1910, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 68, at Page 377. Said lot fronts approximately 44 feet on the northern line of Northern Avenue and extends back therefrom approximately 110 feet. TRACT 4: Those certain tracts of parcels of land being situate in the Town of Lester, Raleigh County, West Virginia, and being more particularly described as follows: PARCEL ONE: BEGINNING at a stake on line of street and with same N 52 W 75 feet to a stake; thence leaving street S 36 W 100 feet to a stake on outside line and with same S 42 75 feet; thence N 36 E 113 feet to the beginning, and containing 7987 square feet. PARCEL TWO: The surface of a certain lot or parcel of land with the appurtenances thereunto belonging situated in the Town of Lester, Raleigh County, West Virginia, bounded and described as follows: BEGINNING at a planted stone on a line of street and with the same N 46 30 W 154 feet; thence leaving street S 40 W 80 feet to outside line and with the same S 42 E 154 feet; thence N 40 E 98 feet to the beginning, and containing 12,628 square feet, and being the same property conveyed to Burnice Pearson and Willie Mae Brown by Erma Canaday, single, by Deed bearing date the 31st day of July 1945, recorded in the Office of the Clerk of the County Court of Raleigh County, West Virginia, in Deed Book No. 216, at page 463. And being the same property acquired by Roger D. Martin, Jr. and Belinda M. Martin, by Deed dated the 15th day of November, 2007, from Johnny C. Bowman and Dorothy M. Bowman, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia prior to or simultaneously herewith. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 146 First Street, Lester, WV 25865. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $4,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
