TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 22, 2005, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50244538, in Book No. 5024, at Page 4538, Walter E. Hodge and Patricia L. Hodge did convey unto BB&T Collateral Service Corporation, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated December 23, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by FV-I, Inc. in Trust for Morgan Stanley Mortgage Capital Holdings LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on February 11, 2016 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows: The following piece or parcel of real estate lying situate on the waters of Beaver Creek, in Shady Spring District, Raleigh County, West Virginia and being part of Tract 4 as shown and designated upon that certain map entitled “MAP SHOWING 8 SURFACE TRACTS AT BEAVER RALEIGH CO. W.VA. TO BE CONVEYED TO ROYALTY SMOKELESS COAL CO. SCALE 1″ = 50 OCT 1955”, which said map is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 355, at page 154A, to which said map reference if here made and made a part hereof, and which said part of said Tract 4 herein conveyed is more particularly described as follows, to wit: BEGINNING at the south easternmost corner of said Tract 4 and being a point on the northern right of way line of the Chesapeake & Ohio Railway; thence from said beginning corner, with the said railroad right of way line, S. 86 f 56′ W 140.59 feet to a stake; thence S. 87 f 09′ W 149.41 feet to a stake; thence on a new line through said Tract 4, N. 4 f 59′ E. To a stake on the northern line of said Tract 4, on the southern bank of Beaver Creek; thence N. 85 f 41′ E. 94.92 feet to a stake; thence N 75 f 16′ E 195.08 feet to a stake, north easternmost corner of said Tract 4; thence leaving the bank of Beaver Creek, S. 4 f 59′ W. 105.78 feet to the point and place of BEGINNING and being the eastern portion of said Tract 4, as shown on a map. And being the same property acquired by the present record holder thereof, Patricia L. Hodge, by deed dated August 6, 2002, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5007, at page 7397. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 149 Tumbling Water Drive, Beaver, WV 25813. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $8,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
