TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 30, 2010, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50393533, in Book No. 5039, at Page 3533, Barbara J. Meadows did convey unto Richard A. Pill ESQ, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated January 14, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on March 19, 2015 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows: The following hereinafter described tract or parcel of land with all appurtenances thereunto belonging, situate on the waters of Big Beaver Creek, Shady Springs District, Raleigh County, West Virginia, more particularly described as follows: Beginning at a stone on the East Bank of a road, the North corner of the Underwood 3.25 acre tract; thence with Underwood’s line S. 78 f 27′ E. 117.2 feet to a stone; thence S 32 f 35′ E 245 feet to a stone, corner to the John Meadows and V.M. Meadows tract; thence with Meadows’ line N 84 f 00′ E 557 feet to a stake in the J.A. Lilly line; thence with said J.A. Lilly line N 27 f 40′ E 401 feet to two spruce pine stumps in the west side of a deep hollow in line of the old Clarkson Prince tract; thence with said line of old Clarkson Prince tract N 50 f 15′ W 458 feet to a stake on the East bank of a road thence with said road bank and 10 feet from the center of said road in a south direction about 876 feet to the beginning; containing 11.3 acres, more or less. EXCEPTING THEREFROM, However the Surface of the following hereinafter described tract or parcel of land, which was conveyed to Esther Bell Daniel by G.S. Brown and Myrtle Brown, his wife, by deed bearing date May 9, 1938, and recorded in the Office of the Clerk of the County Court of Raleigh County, West Virginia, in Deed Book No. 148, at page 154, more particularly described as follow: Beginning at a stake on the Eastern side of a road, and also on the side of a 10 foot alley; thence up the hill with said alley S 78 f 05′ E 110 feet to a stake on the side of said alley; thence continuing with the alley S 33 f 05′ E 83 6 feet to a stake; thence N 56 f 05′ E 76.8 feet to a stake in an orchard; thence down the hill n 35 f 26′ W 153 feet to a stake on the side of a private road; thence with said road S 58 f 40′ W 148 feet to the beginning; containing .35 of an acre. There is further Expressly reserved and excepted from the operation of this deed that easement or right of way over a strip of land Ten Feet wide which was reserved and excepted to L.C. Lilly in that certain deed conveying the 11.3 acres herein conveyed, made by L. D. Lilly et ux to George M. Young, said deed being dated August 26, 1922, and recorded in the Office of the Clerk of the county Court of Raleigh County, West Virginia, in Deed Book Number 79, at Page 347. The property Hereinabove described is the same property which was conveyed to A.H. Pendleton and Nannie Annie Pendleton, his wife, by G.S. Brown and Myrtle Brown, his wife by deed dated June 7, 1939 and of record in said Clerk’s Office in Deed Book 157, at page 306. During the lifetime of the said A. H. Pendleton, he together with his wife, the said Nannie Annie Pendleton, conveyed all but of the above described property the following hereinafter tracts or parcels of land which are hereby specifically excepted from the operation of this deed. First Exception: A tract or parcel of land conveyed by Arthur H. Pendleton and Nannie Pendleton, his wife, to H.C. Lilly, which deed is dated July 5, 1941, and record in said Clerk’s Office in Deed Book 369, at page 250, more particularly described as follows: Beginning at a stake on the southeast end of 4th street in Beaver City, also supposed to be on or near the old Prince line on the West side of a hollow, thence leaving said street end and Prince line and up the hollow S 12 f 30′ E 83 feet to a stake, formerly two hemlocks, (now one stump left) line of J.A. Lilly, (now H.C. Lilly); thence S 29 f W 68 feet to an Ironwood in fence line, thence with the fence N 9 f 00′ W 145 feet to a fence post; thence N 40 f 40′ E 20 feet to aforesaid end of 4th street, (also old Prince Line) and with the end of said street S 53 f 00″ E 30 feet to the point of beginning containing 0.10 acres, more or less. Second Exception: A tract or parcel of land conveyed by A. H. Pendleton and Nannie Annie Pendleton, his wife to David Earl Rees, Sr. by deed dated January 31, 1949, and of record in said Clerk’s Office in deed Book 269 at Page 129 more particularly described as follows: Beginning at a stake on the east bank of a road with line old Clarkson Prince tract S 50 f 15′ E 369 feet to a point on fence line of H. Cleve Lilly tract; thence with said fence line of H. Cleve Lilly tract S 09 f 00′ E 101 ft to a point on H. Cleve Lilly line; thence with said H. Cleve Lilly line S 27 f 40′ W 83 ft. to point on H. Cleve Lilly line; thence N. 53 f 24′ W about 540 ft to point on bank of road 10′ from center of road; thence with said road and 10′ from center of said road in a northeast direction about 200 ft to the beginning, containing 1.9 acres, more or less. Third Exception: A tract or Parcel of land conveyed by A. H. Pendleton and Nannie Pendleton his wife to Roy M. McGraw and Louise McGraw his wife by deed dated April 8, 1953, and of record in said Clerk’s Office in deed book 324 at page 413 more particularly described as follows: Beginning at a stake on the eastern side of a ten foot alley a corner to the lands heretofore conveyed to parties of the seconds part by Kenneth Keaton and Helen Keaton, January 12, 1951 and of record in the Office of the Clerk of the county Court of Raleigh count, West Virginia in Deed Book 296 at Page 343 thence up the hill with said alley s 30 f 05′ E 164 feet to a stake, a corner to the line of Johnny Meadows; thence in an eastern direction with the Meadows’ line 91 feet to a stake; thence through the lands of parties of the first part down the hill and in the northerly direction 213 feet to the line of the lands of parties of the second part conveyed to them by said deed from Kenneth Keaton and Wife of January 12, 1951, as aforesaid; thence with the line of parties of the second part S 56 f 05′ W 76.8 feet to the beginning. Fourth Exception: A tract or parcel of land conveyed by A. H. Pendleton and Nannie Annie Pendleton his wife to Ronald r. Farley and Charlotte Lou Farley his wife by deed dated October 26, 1961, and of record in said Clerk’s Office in Deed book 408, at page 409, more particularly described as follows: Beginning at a stake on the State Road, at a point where the boundary line of the parties of the first part intersects with said State Road, and thence with the State Road, 300 feet to s pipe in the upper line of a new road which the parties of the seconds part have graded out for a new road to their home, and thence with the upper side of said new road, 470 feet to a pine, a corner to the line of the parties of the second part, and thence back with the boundary line between the parties hereto, about 350 feet to the place of beginning, containing 56,000 square feet, more or less. Being the same property conveyed to James Meadows and Barbara Meadows in deed dated 5/12/64, recorded 5/25/64 in book 430 and page 558 in the County of Raleigh and State of West Virginia. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.
