TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 4, 2005, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50173282, in Book No. 5017, at Page 3282 and re-recorded in Document No. 50187894 , in Book No. 5018, at Page 7894, Oatie D. Skaggs and Megan A. Skaggs did convey unto J.W. St. Clair and William Levine, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated May 10, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. Bank, N.A., as trustee for Mid-State Capital Corporation 2005-1 by Ditech Financial LLC, as servicer with delegated authority to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on June 24, 2016 at 9:30 a.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Marsh Fork District, Raleigh County, West Virginia, and more particularly described as follows: All that certain piece, or parcel of real estate situate in Marsh Fork District, Raleigh County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a stake, corner to Arlie Dickens, thence N. 63 f 05′ E. 250.00 feet to a stake; thence with the Willis Webb line, N. 56 f 40′ W. 164.00 feet to a stake; thence N. 88 f 10′ W. 185.00 feet to a stake; thence S. 27 f 54′ E. 228.00 feet back to the point of beginning, containing 0.93 acre, more or less. And being more particularly set out on a map which is attached to deed recorded in Deed Book 642, at Page 668, which map is dated 9-16-78, Scale 1″ = 50′ and drawn by I.P. Snodgrass. EXCEPTING AND RESERVING a right of way as more particularly bounded and described as follows: BEGINNING at a stake on the corner of Arlie Dickens, thence leaving Arlie Dickens line N. 63 f 05′ E. 8.00 feet to a stake; thence through the property herein conveyed, N. 27 f 54′ W. 228.00 feet to a stake; thence N. 88 f 10′ W. approximately 9.21 feet to a stake; thence with the Arlie Dickens line, S. 27 f 54′ E. 228.00 feet back to the point of beginning. And a 10′ wide easement for ingress and egress, located in Marsh Fork District, Raleigh County, West Virginia, and being more particularly described as follows: BEGINNING at a point in the southerly edge of Horseshoe Road at its intersection with a 10′ right of way running through the lands N/F owned by Albert Cook which point is distant N. 40 f 20′ 06″ W. 407.51 feet from a found axle property corner; thence running with the center line of said 10′ right of way the following 5 calls: S. 23 f 11″ 09″ E. 71.97 feet, S. 01 f 13′ 17″ W. 74.27 feet, S. 09 f 12′ 27″ E, 31.83 feet, S. 39 f 05′ 35″ E. 161.90 feet, S. 22 f 25′ 06″ E. 4.57 feet reference S. 86 f 00′ 53″ E. 128.40′ feet to said found axle property corner; said right of way is shown upon a plat prepared by Converse Surveying Scott Depot West Virginia, attached hereon and made a part hereof. And Being the Same property recorded in Deed Book 642 Page 668 in the County Clerk’s office of Raleigh County. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 140 Horseshoe Road, Arnette, WV 25007. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $5,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
