TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated April 17, 1995, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 72, at Page 1406, and re-recorded in Deed of Trust Book 74, at Page 260, and by Modification Agreements in Book 5042, at Page 6751 and Book 5054, at Page 6700, Rick A. Martin and Robin S. Martin did convey unto Bradley P. Wartella and Alan H. Larrick, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on Wednesday, July 13, 2016, at 1:17 p.m. The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Beckley District, Raleigh County, West Virginia, and more particularly described as follows: That certain lot or parcel of land situate in the City of Beckley, Raleigh County, West Virginia, and being a part of Lot No. 9, of Section 3, of the Fairview Truck Farms, as shown on a map of said addition of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book No. 7, at Page 14, to which said map reference is here made and made a part hereof for a more particular description of said Lot No. 9. There is EXCEPTED AND RESERVED FROM THE OPERATION OF THIS DEED that part of said Lot No. 9, of Section 3, of the Fairview Truck Farms, and being a southern portion thereof fronting one hundred feet on a street, extending back therefrom with Lots Nos. 8 and 10 a distance of two hundred feet, and which said part of said Lot No. 9 herein excepted and reserved is shown and designated as Lot 9A on that certain map entitled “Plot Plan Division of Lot 9, Section 3, Fairview Truck Farms,” to which said map reference is here made and made a part hereof, and which said map is recorded with that certain deed conveying that part of Lot No. 9 herein excepted and reserved, made by Jean Lucas, widow, to John W. Billups and Joan B. Billups, his wife, dated January 15, 1964, and of record in said Clerk’s Office in Deed Book No. 428, at Page 24. And being more particularly bounded and described by a more recent survey as follows: A tract or parcel of land being a part of Lot 9, Section 3 of ‘Fairview Truck Farms’ situated in the City of Beckley, Raleigh County, West Virginia, and being more particularly described as follows: Beginning at a 1/2-inch rebar, set on the southeastern right-of-way line of Crescent Road, said rebar being a common corner between Lots 8 and 9; thence leaving said right-of-way line and with the common line between said Lots 8 and 9 S. 23 deg. 43′ E. 235.60 feet to a roof bolt, found; thence leaving said Lot 8 and running thru Lot 9 with a new line S. 66 deg. 17′ W. 100.00 feet to a 1/2-inch rebar, set on the common line between Lots 9 and 10; thence with said common line N. 23 deg. 43′ W. 235.60 feet to a 1/2-inch rebar, set on the previously mentioned right-of-way line of Crescent Road, said rebar being a common corner between Lots 9 and 10; thence leaving said Lot 10 and with said right-of-way line N. 66 deg. 17′ E. 100.00 feet to the point of beginning and containing 23,560 square feet (0.541 acres), more or less, as surveyed by Eastern Surveying, Inc., in April, 1995. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 309 Crescent Road, Beckley, WV 25801. AND BEING the same real estate which was conveyed to Rick A. Martin and Robin S. Martin, by Deed dated April 11, 1995, from Lendo K. Walker and Shirley Walker and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 72, at Page 1461. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
