The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 28, 2006, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed of Trust Book 599, at Page 166, A. Perry McGuire and William P. McGuire did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse, in Lewisburg, West Virginia, on

ALL OF THOSE TWO (2) CERTAIN LOTS OR PARCELS OF REAL ESTATE IN THE CITY OF LEWISBURG, GREENBRIER COUNTY, WEST VIRGINIA, MORE PARTICULARLY DESGINATED AND DESCRIBED AS LOTS NO. 30 AND 31 OF THE MARGARET NELSON LAING SUBDIVISION OF RECORD IN THE OFFICE OF THE CLERK OF THE COUNTY COMMISSION OF GREENBRIER COUNTY, WEST VIRGINIA, IN RECORD ON MAPS BOOK NO. 2 AT PAGE 58.

“BEGINNING AT A STAKE ON LINE OF MCGUIRE (PARTY OF THE SECOND PART) AND CORNER TO TRACT NO. 2 THENCE WITH MCGUIRE S 34-38 E 90 FEET TO AN IRON FENCE POST, A CORNER TO MCGUIRE AND ON THE NORTHWEST SIDE OF A 12 FOOT ALLEY AND WITH SAME, S 55-32 W 100 FEET TO A STAKE BY ALLEY, A CORNER TO TRACT NO. 1, (PROPERTY OF ROBERT E. SURGERON), AND WITH SAME N 34-38 W 90 FEET TO A STAKE, A CORNER TO TRACT NO. 2; THENCE WITH SAME N 55-32 E 100 FEET TO THE PLACE OF BEGINNING, CONTAINING 9,000 SQUARE FEET.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 332 Church Street, Lewisburg, WV 2491.
AND BEING the same real estate which was conveyed to William P. McGuire by Deed dated June 14, 2002, from Alex Perry McGuire and Sharon A. McGuire, who both reserved a life estate in the property, and recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 475, at Page 405. The said Sharon A. McGuire passed away from this life on July 8, 2002.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
