The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 28, 2017, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 8757830, in Book No. 1981, at Page 188, Marc Pfaff did convey unto First American Title Insurance Company, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated February 12, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC, to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Lubeck District, Wood County, West Virginia, and more particularly described as follows:

 

All those parcels of land situate and being in the District of Lubeck, County of Wood, State of West Virginia, which is more particularly bounded and described as follows:

PARCEL ONE:

Beginning at a point, the southeasterly corner of Dupont Road (West Virginia Secondary Route No. 31) and Hill Drive, thence S. 18 degrees 28′ W. along the easterly line of Hill Drive, 248 feet to a point; thence S. 80 degrees E. along the southerly line of the 40-foot right of way hereinafter described, 160 feet to a point, which point is the place of beginning; thence, continuing with the southerly line of said 40-foot right of way, S. 80 degrees E. 76.6 feet to the common line between this tract and Woodcliffe Acres Addition (11 P.B. 22); thence with the said common line S. 4 degrees 33′ W. 152.77 feet to a point; thence along the common line between this tract and the tract now or formerly owned by Graham Packing Co., Inc., (536 D.B. 379) N. 58 degrees 10′ W. 98 feet to a point; thence N. 10 degrees 00′ E. 115 feet to the place of beginning, containing 10,900 square feet.

PARCEL TWO:

BEGINNING at a 3/4″ iron pipe found in the southerly line of 40′ private right-of-way known as Lakeview Street, said pipe being the northwest corner to a tract conveyed to Tony and Denise Johnson of record in Deed Book 1030 page 895; thence leaving Lakeview Street and with Johnson, S 9-50-01W 115.03 feet to a 3/4″ iron pipe found, said pipe being corner to a tract conveyed to Westbanco Trust and Investment of record in Deed Book 1041 page 523; thence with said Westbanco N 80-09-59 W 20.00 feet to a 1/2″ rebar set; thence leaving Westbanco, N 9-50-01 E 115.09 feet to a 1/2″ rebar set in the southerly line of the aforesaid Lakeview Street; thence with said Lakeview Street, S 80-00-00 E 20.00 feet to the place of BEGINNING, and containing 2301.239 square feet.

 

At the time of the execution of the Deed of Trust, this property was reported to have an address of:  55 Hill Dr, Washington, WV 26181.

 

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes.

 

The subject property will be sold in “AS IS” condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

TERMS:  $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

 

FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

 

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
