The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 30, 2016, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 8710998, in Book No. 1925, at Page 280, Rebecca A Frederick and Charles L Frederick did convey unto R. Vance Golden, III, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated February 12, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Lakeview Loan Servicing, LLC, to foreclose thereunder, will offer for sale at public auction at the front door  of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Lubeck District, Wood County, West Virginia, and more particularly described as follows:

 

All the following lots or parcels of land, described as follows:

First Tract: Beginning at iron rod found at the most Southerly corner of lot number two of Lubeck Hills, Section âFã a plat of which is of record in Plat Book 25 at Page 39. THENCE North 68 degrees 24 minutes 22 seconds West for a distance of 351.42 feet to an iron rod found corner to said lot.

THENCE with another line of said lot North 27 degrees 56 minutes 35 seconds East for a distance of 89.34 feet to an iron rod found corner to said lot.

THENCE with another line of said lot North 73 degrees 28 minutes 27 seconds East passing over a 15 foot utility right of way also being created herein at 198.24 feet for a total distance of 213.24 feet to an iron rod found in the Southerly right of way of a cal-de- sac at the end of Lois Lane.

THENCE with said Lois Lane along a curve to the left having radius of 37.50 feet and an arc length of 62.06 feet, being subtended by a chord o South 63 degrees 56 minutes 51 seconds East for a distance of 55.22 feet to an iron rod set.

THENCE leaving said Lois Lane passing over said 15 foot utility right of way and crossing said lot number two South 21 degrees 21 minutes 38 seconds East for a distance of 210.59 feet to an iron rod set in a line of said lot.

THENCE along said lot line South 43 degrees 22 minutes 22 seconds West for a distance of 66.77 feet to the point of beginning, containing a total area of 1.31acres.

Second Tract: Beginning at an iron rod found at the most Northerly corner of lot number two of Lubeck Hills, section âFã a plat of which is of record in Plat Book 25 at Page 39, said point lying in the Easterly line of Lois Lane.

THENCE leaving said Lois Lane with a line of said lot South 56 degrees 48 minutes 41 seconds East passing over a 15 foot utility right of way also being created herein for a total distance of 238.42 feet to an iron rod found corner to said lot.

THENCE with another line of said lot South 54 degrees 13 minutes 17 seconds West for a distance of 197.16 feet to an iron rod found corner to said lot.

THENCE with another line of said lot South 43 degrees 22 minutes 22 seconds West for a distance of 80.00 feet to an Iron rod set.

THENCE crossing said lot North 21 degrees 21 minutes 38 seconds West passing over a 15 foot utility right of way at 195.59 feet for a total distance of 210.59 feet to an iron rod set in the Southerly right of way of a cal-de-sac at the end of said Lois Lane.

THENCE with said Lois Lane along a curve to the left having a radius of 37.50 feet and an arc length of 44.57 feet, being subtended by a chord of North 34 degrees 35 minutes 27 seconds East for a distance of 41.99 feet to a point.

THENCE again with said Lois Lane along a curve to the right having a radius of 20.00 feet and an arc length of 16.03 feet, being subtended by a chord of North 23 degrees 29 minutes 42 seconds East for a distance of 15.60 feet to a point.

THENCE again with said Lois Lance North 46 degrees 27  minutes 20 seconds East for a distance of 85.55 feet to the point of beginning, containing a total area of 1.00 acre.

First Tract and Second Tract consist of all of above mentioned Lot Number two of Lubeck Hills, Section âFã of record in Plat Book 25 at Page 39 and are shown on a plat of the division of the said Lot Number Two of Lubeck Hills Section âFã in Plat Book 1A, at page 583, to which reference is had and made for a more particular description thereof.

 

At the time of the execution of the Deed of Trust, this property was reported to have an address of:  118 Lois Ln, Washington, WV 26181.

 

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes.

 

The subject property will be sold in âAS ISã condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

TERMS:  $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

 

FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

 

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
