The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 15, 2010, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 647557, in Book No. 1608, at Page 691, Gary E. Hupp and Barbara C. Hupp did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated March 4, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Branch Banking and Trust Company to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Parkersburg District, Wood County, West Virginia, and more particularly described as follows:

 

Located in the City of Parkersburg, County of Wood, and State of West Virginia, to-wit:

TRACT ONE: BEGINNING at an iron pipe, said point being the Northwest comer of Lot #55 of Belmont Manor No. 5, at plat of which Addition is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia; thence with the back line of Lot 54 of said Addition N 82-27 W 42.5á to an iron pipe; thence N 2-23 W 157.91á to an iron pipe in the Southern right of way of Valley Road; thence with said right of way N 87-27 E 65á to an iron pipe being the North West corner of a lot conveyed to Paul Lewis in Deed Book 632, at page 287, by Intra-City Realty, Inc.; thence with the line of the Paul Lewis tract S 2-33 E 165.61á to an iron pipe in the back line of Lot No. 55; thence with the line of Lot No. 55, S 89-25 W. 23.06á to the place of beginning, containing 0.24 acres.

TRACT TWO: BEGINNING at an iron pipe, said point being the North East corner of Lot 53 of Belmont Manor No. 5, a plat of which Addition is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia; thence with the line of Lot No. 53; N 65-36 W 9.31á to an iron pipe; thence N 2-33 W 144.01á to an iron pipe set in the southern right of way of Valley Road; thence with said right of way N 87-27 E 65á to an iron pipe; thence S 2-33 E 157.91á to an iron pipe in the back line of Lot #54 of said Addition; thence N 82-27 W 57-53 to the place of beginning, containing 0.22 acre.

TRACT THREE: BEGINNING at an iron pipe in the back line of Lot No. 53 of Belmont Manor No. 5, a plat of which is on record in the Office of the Clerk of the County Commission of Wood County, West Virginia; thence with the back line of Lot #53 N 65-36 W 45.04á to an iron pipe; thence N 2-33 W 123.62 to an iron pipe in the southerly right of way of Valley Road; thence N 87-27 E 144.02á to an iron pipe from which the North East corner of Lot #53 is S 65-36 W 9.31á and also being the place of beginning, containing 0.12 acre.

 

At the time of the execution of the Deed of Trust, this property was reported to have an address of:  2416 Valley Road, Parkersburg, WV 26101.

 

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes.

 

The subject property will be sold in âAS ISã condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

TERMS:  $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

 

FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

 

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
