The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 11, 2015, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 8646296, in Book No. 1870, at Page 895, Judy D Whitehair did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 22, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Quicken Loans Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

TRACT ONE:
Beginning at the point of intersection of the Easterly line of Stephenson Avenue with the Southerly line of a 20 foot alley, said beginning point being the Northwesterly corner of Lot No. 213, of Oakhurst Addition, as shown on the plat thereof, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 2, at Page 21; thence running with said line of said alley in an Easterly direction, 71.69 feet to a point; thence in a Southwesterly direction parallel with the common line of Lots Nos. 213 and 214 of said addition, 50 feet to a point; thence in a Northwesterly direction, 73.01 feet to a point in the Easterly line of Stephenson Avenue; thence with said Avenue running in a Northeasterly direction 50 feet to the place of beginning, being a part of Lot, No. 211 and a 10.24 foot strip off Lot No. 214 of said Oakhurst Addition.

Beginning at a point in the Easterly line of property now owned by Teresa A. Sprout (Deed Book 918, Page 110), which point lies in the Southerly line of a 20 foot wide right of way running from Plum Street to Stephenson Street; thence leaving said right of way S. 26 degrees 36 minutes 30 seconds W. 50 feet to a point; thence at right angles S. 63 degrees 23 minutes 30 seconds E 10 feet to a point; thence N. 26 degrees 36 minutes 30 seconds E. 50 feet to a point in the Southerly line of the aforesaid 20 foot right of way; thence at right angles, N. 63 degrees 23 minutes 30 seconds W. 10 feet to the place of beginning, being a strip of ground 10 feet in width by 50 feet in length, a part of Lot No. 214 of Oakhurst Addition to the City of Parkersburg, as shown on a plat of said Addition of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 2, at Page 21.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1338 Stephenson Ave, Parkersburg, WV 26101.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way reservations which may be a matter of record in the aforesaid Clerkás Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording cost and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in âAS ISã condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $7000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
