BEGINNING at a 5/8 inch rebar, set, corner to Christopher A. and Tracy L. Crouse (D.B. 162 Pg. 660) and in the line of Ruth V. Heironimus (W.B. 10 Pg. 258); thence with said Heironimus, N. 71º 43′ 38 W., 148.23 feet to a 5/8 inch rebar, found at the east edge of W. Va. County Route 17, corner to said Heironimus and in the line of Harry C. Luttrell (W.B. 8 Pg. 195, 44 acre tract); thence with said Luttrell and with the east edge of said Route 17, N. 07º 01′ 15″ E. 52.38 feet; thence, N. 16º 31′ 47″ E., 112.13 feet; thence, N. 26º 16′ 36″ E., 121.30 feet to a 5/8 inch rebar, set, corner to Sheldon K. and Christine Younker (D.B. 134 Pg. 163); thence leaving said Luttrell and said Route 17 and with said Younker, S 75º 53′ 42″ E., 109.19 feet to a 5/8 inch rebar, set; thence leaving the line of said Younker and extending into the remainder of Opal V. Crouse (of which is a survey) along a line claimed by Sheldon Younker, S. 39º 44′ 38″ E., 38.09 feet to a 5/8 inch rebar, set; thence S. 15º 43′ 36″ E., 77.87 feet to a 1-inch iron rod found, claimed as an original corner by said Younker; thence S. 72º 22′ 54″ E., 97.43 feet to a 5/8 inch rebar, set in the line of said Heironimus, corner to said Younker (D.B. 134 Pg. 163); thence with said Heironimus, S. 15º 09′ 48″ W., 26.70 feet to 5/8 inch rebar, set, corner to said Crouse; thence leaving said Heironimus and with said Crouse, N. 71º 43′ 38″ W., 148.50 feet; thence S. 15º 09′ 48″ W., 181.50 feet to the point of beginning and containing 1.112 acres as surveyed by Michael M. Crawford, Licensed Land Surveyor on January 31, 1995 and as shown on Plat No. 95009, and to which reference is here made.

SUBJECT TO a Right-of-Way for ingress and egress 12 feet wide in width running along the southernmost boundary of the above described real estate as shown on the aforementioned plat.

Reference is made to that certain replat, No. 2004011, by Michael M. Crawford entitled ” A Replat of the Land of Harvey R. and Evelyn Puffinberger,” of record in the aforesaid County Clerk’s Office in Deed Book 212, at page 382.

Beginning at (1) a three foot white oak, thence in an easterly direction, along the line of Luttrell 269 feet to (2) a one inch iron bar (set), thence in a southerly direction 45 feet to (3) a one inch iron bar (set), thence in an easterly direction 209 feet to (4) three foot white oak tree, thence in a southerly direction 95 feet to (5) a one inch iron bar (set), thence in an easterly direction 86 feet to (6) a twelve inch white oak tree, corner to Eva Crouse, thence in a northerly direction 140 feet to the place of beginning, containing 20,275 square feet, as marked and measured by the Grantees.

Reference is hereby made to that certain Order of the Circuit Court of Morgan County, West Virginia, in Civil Action No. 04-C-83, which Order is of record in Deed Book 233 at Page 518.

BEING the same real estate conveyed unto Mickey Vernon Mencer by Christine Younker, by deed dated July 10, 2020, of record in the Office of the Clerk of the County Commission of Morgan County, West Virginia, immediately prior hereto.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 589 Pine Grove Rd, Berkeley Springs, WV 25411.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
