TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 19, 2008, and duly recorded in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Document No. 741837, in Book No. 329, at Page 728, Samuel L Horning did convey unto Dawn White, Attorney, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MidFirst Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Morgan County Courthouse in Berkeley Springs, West Virginia, on August 26, 2025 at 9:30 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 07 – Sleepy Creek District, Morgan County, West Virginia, and more particularly described as follows: Situate in Sleepy Creek District of Morgan County, West Virginia, and more particularly described as follows: All of LOT NO. SEVENTY-FOUR (74), PHASE III, containing 2.59 acres, Sleepy Creek Mountain Retreat Subdivision, as set forth on a survey approved by the Morgan County Planning Commission dated September 26, 1988, and recorded on September 27, 1988 in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Map Book 6, at page 26. Together with a right of way for ingress and egress over and upon all roads and rights of way as set forth on the aforesaid plat. SUBJECT TO AND TOGETHER WITH all of those rights, reservations, restrictions, covenants, conditions, assessments, liens, easements, and rights of way (including, but not limited to, the right of access to the property hereinbefore conveyed over the streets and roads and common properties shown on the recorded plat of Section III, Sleepy Creek Mountain Retreat Subdivision) set forth in that certain Declaration of Covenants, Conditions and Restrictions for Sleepy Creek Mountain Retreat Subdivision, dated May 3, 1988, and recorded in the aforesaid Clerk’s Office in Deed Book No. 145, at page 400, the Amended Declaration of Covenants, Conditions and Restrictions in Deed Book 153, at page 162 and Deed Book 221, at page 74, and the party of the second part, by his signature hereafter appended, does covenant and agree for himself, his heirs, devisees, and assigns, to pay all the assessments, liens, easements, rights of way, and obligations set forth in or referred to in said Declaration of Covenants, Conditions and Restrictions. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition.
