Kiser did convey unto Alan H. SNODGRESS, LLS 359”, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 599, at page 68A which said condominium home unit is more particularly described as follows: All of Home Unit No. 132 and patio and deck areas of the Cherrywood Villas Condominium as the same is shown on the Declaration Plan entitled “DECLARATION PLAN FOR CHERRYWOOD VILLAS CONDOMINIUM OF MULTI-UNIT AREA CONSISTING OF 4.20034 ACRES LOCATED ON WEST VIRGINIA SECONDARY ROUTE 9/7 OWNED AND DEVELOPED BY DARYL R. WILLIAMS, BUILDERDEVELOPER, INC., SCALE 1″ = 40′, JUNE 15, 1978, PREPARED BY SOUTHERN SURVEYING AND ENGINEERING CO., INC., BECKLEY, WEST VIRGINIA, HAROLD R. SNODGRESS, LLS 359.” and of record in the aforesaid Clerk’s Office in Map Files Nos. 123B and 124A (Hereinafter called “Declaration Plan”) Together with a 3.0303{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} undivided interest as tenant in common in and to the common elements which are assigned to the said Home Unit No. 132 and described in “DECLARATION ESTABLISHING A PLAN FOR CONDOMINIUM OWNERSHIP OF A MULTI-UNIT AREA CONSISTING OF 4.20034 ACRE IN SHADY SPRING TAX DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, PURSUANT TO CHAPTER 36A OF THE CODE OF WEST VIRGINIA OF 1931, AS AMENDED” (also known as the Unit Property Act), which said Declaration is dated the 30th day of June, 1978 and of record in the aforesaid Clerk’s Office in Deed Book 599, at page 108 (hereinafter called “Declaration”). And being the same property acquired by Jim E. Kiser, by deed dated March 29, 2006, from Autumn Moorefield, to be recorded prior to or simultaneously herewith. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 132 Cherrywood Villa, Beaver, WV 25813. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
