The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 10, 2023, and duly recorded in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed of Trust Book 495, at Page 426, Brian C. Vangosen did convey unto Sansalone & Sansalone, Attorneys at Law, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Morgan County Courthouse, in Berkeley Springs, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Rock Gap District, Morgan County, West Virginia, and more particularly described as follows:
All that certain parcel of real property, with the improvements thereon and the appurtenances thereunto belonging, situated in the Rock Gap District, Morgan County, West Virginia, designated and described as “Beginning at (1) a planted stone (found) in the line of J.A. Kemeka (Deed Book 63, at page 267) being a corner to H.S. Cardhill (Deed Book 109, at page 80) thence with Cardhill S. 61° 35′ 24″ E. 655.49 feet to a concrete monument (found) corner to Cardhill and J.S. Lynch (Deed Book 99, at page 499) continuing same with Lynch 339.01 feet more (994.5 feet in all) to (2) a planted stone (found) corner to Lynch thence with a new division line S. 55° 17′ 43″ E. 146.77 feet to a number five rebar (set) continuing same 333.42 feet more to a point in the center of West Virginia Secondary Route 38/5, continuing same 102.81 feet more (.583 feet in all) to (4a) a number five rebar (set) in the line of J.B. Cain (Deed Book 95, at page 731) thence with the line of Cain S. 34° 26′ 46″ W. 310.73 feet to (4b) a number five rebar (set) in the line of J.B. Cain corner to the 13.5+ acre South Tract, thence with the same N. 62° 02′ 23″ W. 62.9 feet to the center of West Virginia Secondary Route 38/5 continuing same 1479.63 feet more (1542.53 feet in all) to (8) a point in the line of J.A. Kemeka (Deed Book 63, at page 267) thence with Kemeka N. 28° 35′ E. 72.26 feet to a number five rebar (found) in said line, continuing same 312.79 feet more (385.05 feet in all) to the Point of Beginning, containing 13.15+ acres.” as set forth upon that certain Subdivision Survey Plat prepared by HD Wachter Inc., dated March 23, 1981 and recorded in the Office of the Clerk of the County Commission, Morgan County, West Virginia in Deed Book 118, at page 3.
At the time of this transaction, the real property was assigned a Morgan County tax identification as Rock Gap District, Tax Map 0007, Parcel 0016 0005 0000, and the improvements thereon are identified for postal purposes as 578 McCoy Road, Berkeley Springs, WV 25411.
TOGETHER WITH a 2006 SWA265 Redman Homes SWA265 Serial No.:  122-000-H-046247AB 27 x 44 located thereon.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 578 McCoy Road, Berkeley Springs, WV 25411.
AND BEING the same real estate which was conveyed to Brian C. Vangosen, by Deed dated February 10, 2023, from 304 Investments LLC, and recorded in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book 290 at Page 320.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
