The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 7, 2017, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5064, at Page 5233, David Michael Vass did convey unto Clyde A. Smith, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on
March 5, 2026, at 1:10 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the City Beckley District, Raleigh County, West Virginia, and more particularly described as follows:
That certain lot of surface land, and all improvements thereon and appurtenances thereto situate on Oakwood Avenue in the City of Beckley, in Raleigh County, West Virginia, and described as follows:
BEGINNING at a stake, the North West corner of a lot sold by J.F. Burgess and wife to Tilden S. Williams, thence with Williams' line, S. 63 1/2 E. 20 1/8 poles to a stake, thence S. 35 W. 4 poles and one line to a stake, thence N. 63 1/2 W. 20 2/5 poles to the Soak Road, (now Oakwood Avenue) and with same N. 38 1/2 E. 4 poles to the beginning, containing one-half acre.
And being the same property conveyed to David Michael Vass by Deed dated the 1st day of February, 2017, from Nellie Josephine Amato, said Deed is to be recorded in the Office of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 629 South Oakwood Avenue, Beckley, WV 25801.
AND BEING the same real estate which was conveyed to David Michael Vass, by Deed dated February 1, 2017, from Nellie Josephine Amato by Steve Ledahawsky, Jr., her ATTORNEY IN FACT, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5064 at Page 5231.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
