The undersigned Substitute Trustees, by virtue of the authority vested in them by that certain Deed of Trust dated September 29, 2010, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 1621, at Page 856, Kenneth F. Fulton, II did convey unto David G. Palmer and Susan L. Petrella, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Richard A. Pill and David D. Pill as Substitute Trustees by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustees having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Parkersburg District, Wood County, West Virginia, and more particularly described as follows:

 

Situate in the City of Parkersburg, County of Wood, and the State of West Virginia, more particularly bounded and described as follows, to wit:

 

BEGINNING at a point in the southerly line of Foley Avenue, which said point is 80 feet easterly, measured along said line of Foley Avenue, from the easterly line of Broad Street; thence in a southerly direction, parallel with Broad Street, 120 feet to a point; thence in an easterly direction parallel with the southerly line of Foley Avenue, 80 feet to a point; thence in a northerly direction parallel with said easterly line of Broad Street, 120 feet to the southerly line of Foley Avenue; thence with said line of Foley Avenue; N. 63 deg. 15á W. 80 feet to the place of beginning.

 

This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

 

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1906 Foley Avenue, Parkersburg, WV 26104.

 

AND BEING the same real estate which was conveyed to Kenneth F. Fulton, II, by Deed dated July 20, 2010, from John Russell Pfalzgraf, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1158, at Page 889.

 

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

 

The subject property will be sold in âAS ISã condition. The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
