The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated December 7, 2007, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 1466, at Page 654, Gifford D. Hartness did convey unto David G. Palmer and Susan L. Petrella, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Parkersburg District, Wood County, West Virginia, and more particularly described as follows:

 

Situate in the City of Parkersburg, County of Wood, and the State of West Virginia, more particularly bounded and described as follows, to-wit:

 

BEING all of Lot No. Forty-Four (44) in Parkersburg Industrial Companyás Fairplains Addition No. 3, as laid down, designated and described on a plat of said Addition which plat is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 2, at Page 96, to which plat reference is here made for a full and complete description of said lot, tract or parcel of land.

 

This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

 

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1315 Cresent Street, Parkersburg, WV 26101.

 

AND BEING the same real estate which was conveyed to Gifford D. Hartness, by Deed dated September 13, 2007, from Gregory L. Hartness and Gifford D. Hartness and Gregory L. Hartness, as Attorney-in-Fact for George W. Hartness, Jr., Gary W. Hartness and Geffrey L. Hartness, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1122, at Page 272.

 

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

 

The subject property will be sold in âAS ISã condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
