The undersigned Trustees, by virtue of the authority vested in them by that certain deed of trust dated September 11, 2003, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 1151, at page 22, Brian Reed, also known as Bryan Reed, and Lisa Reed did convey unto R. Vance Golden, III, Trustee, certain real property described in said deed of trust; and the beneficiary has elected to appoint Teays Valley Trustees, LLC as substitute Trustees by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned deed of trust and the undersigned Trustees, having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse, 1 Court Square, Parkersburg, West Virginia 26101 on:

Located in the City of Parkersburg, County of Wood and State of West Virginia, to-wit:

BEING all of Lot No. Sixty-one (61) of Newberry Subdivision on Sky Line Drive in South Parkersburg, as shown on a plat of said Subdivision, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 5, Page 68, to which said plat, so of record, reference is hereby made and had for a more particular description of said lot.

There is excepted and reserved from this conveyance a parcel of real estate conveyed to Charles D. Peck Builders, Inc., a West Virginia corporation, by deed dated November 18, 1983, and recorded in the aforesaid Clerkàs Office in Deed Book 796, at Page 618, and described as follows:

BEGINNING at an iron rod set in the northerly line of 16th Avenue (formerly 11th Avenue) at the common corner of Lots 61 and 62 of Newberry Subdivision; thence with the northerly line of 16th Avenue, N. 72õ 48à W. 60.35 feet to an iron rod set; thence with the common line of Lots 60 and 61 of said Addition N. 15õ 36à E. 150 feet to an iron rod set; thence S. 72õ 18à E. 79.52 feet to an iron rod set in the common line of Lots 61 and 62 of said Addition; thence S. 22õ 56à W. 150 feet with the common line of Lots 61 and 62 of said Addition 150 feet to the place of beginning, being the southerly part of Lot 61 of Newberry Subdivision on Sky Line Drive in South Parkersburg, as shown on a plat of said Subdivision of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 5, at Page 68, containing 10,464 square feet, more or less, and more particularly described by the plat of Paul K. Marshall, L.L.S. #580, bearing date the 2nd day of November, 1983.

It is understood and agreed that this conveyance is made subject to all the restrictions, covenants and agreements contained in former deeds.

The aforesaid property is SUBJECT TO any and all easements, rights-of-way, conditions, covenants and restrictions of record or in existence.

The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and to any further matters announced at said sale. The property is sold subject to an accurate survey at purchaser’s expense.

The sale of the foregoing real property will also be made expressly subject to any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the deed of trust referred to herein.

The Trustees reserve the right to adjourn the sale, for a time, or from time to time, without further notice, by announcement at the time and place of sale describe above or any adjournment thereof. The Trustees reserve the right to reject any and all bids.

The subject property will be sold in âAS ISã condition. The Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The Trustees will deliver a trustees’ deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by W. Va. Code Œ38-1-6. The Trustees make no representations and warranties about the title of the real estate to be conveyed. If the Trustees are unable to convey insurable or marketable title to purchaser for any reason, purchaser’s sole remedy is return of deposit.

TERMS OF SALE: $7,250.00 cash in hand at the time of sale in the form of a certified check or cashier’s check made payable to âTeays Valley Trustees, LLC,ã and the balance in cash closing within 30 days of the date of the sale. Purchaser shall pay for transfer stamps and recording fees. Additional terms of sale may be announced prior to the sale.
