PUBLIC HEARING MEETING: THURSDAY, November 17, 2016 4:30 p.m. NOTICE OF HEARING ZONING BOARD OF ADJUSTMENT Notice is hereby given that the following has been appealed from the action of the City Manager in refusing to grant the following zoning permits: ITEM 1: Application # 10,250 by Kayla Poff to erect a 6 ft. high wood fence along Cumberland Road, would be considered as side property line. Building to be used for fence on my property located at 2400 Verdun Heights between Jefferson Street, Cumberland Road and Verdun Heights; Lot No. 14, Section No. 959 or County Map 54, Parcel No. 95 (Zoning: R1). REASON FOR REFUSAL: Section 44-90 Accessory uses in residential areas. (a) Fences or enclosure walls. (1) A fence or enclosure wall shall not exceed a height of three feet when located along the front line or when located on any side line, from the front lot line to the setback line. All wire fences are prohibited along front and side lines, except by approval of the zoning board of adjustment. (3) A fence or enclosure wall along a street, whether side or rear, shall not exceed three feet in height. ITEM 2: Application # 10,249 by Marcy Norman to erect a 38 x 35 addition to back of house. To be used for rooms on property located at 627 Frederick Street between Woodrow Avenue, Fredrick Street and Louden Street; Lot No. 8, pt. 7, Section No. 885 or County Map 32, Parcel No. 240 (Zoning: R-2). REASON FOR REFUSAL: Section 44-88 Lands, usable open space; parking. (a) Front yard. For every lot in a residential district abutting on a street, front yards of the following minimum depth shall be provided: Residence District Minimum Depth R-2 30 feet Appendix B to Chapter 44. Front yards and Setback Lines (2) For a corner lot in a residential district, the minimum depth of yard along either frontage shall be the depth of yard which is required along the same street for the next adjacent lot unless separated therefrom by an intersecting street; provided, nothing in this requirement shall be so interpreted as to reduce the buildable width of a corner lot of record at the time of the passage of this zoning ordinance to less than two-thirds of the total width of the lot or to less than twenty-six (26) feet in a residence district. (Code 1974, ch. 23, app. B; Ord. No. 79-9, 11-13-1979). ITEM 3: Application # 10,252 by Harold Collins to erect an approx. 12 x 24 garage addition by side of house. To be used for a garage on my property located at 700 Parkway between Spring Garden Avenue, Parkway and Mountain View; Pt. Lot5, pt. 12., Section 965 or County Map 27, Parcel No.224 (Zoning R1). REASON FOR REFUSAL; Section 44-88 (b)Side yard. For every building in a residence district side yards of the following minimum width (in feet) shall be provided: Residential District R-1 Required -10 feet ITEM 4: Application #10,253 by Curtis French to erect an approx. 8′ x 18′. 8″ long wall sign. To be used for signage on my property located at 301 North Street between North Street, Jefferson Street and South Street; Lot No. 1,2,3,4, Section No. 812 North Jefferson or County Map 33, Parcel No. 53 (Zoning: BC). REASON FOR REFUSAL: Sec. 44-300. – Business and industrial districts. (a) On-site signs. On-site signs in business and industrial districts shall be subject to the following regulations: (1) Wall signs. Signs shall be stationary, nonflashing, single-faced and be attached to a building. No sign shall project more than 18 inches beyond the face of a building or project above the parapet or roof line of the building face to which it is attached. The face areas of such signs shall not exceed a length of 25 feet nor a height of six feet. ITEM 5: Application #10,254 by Jerry Crews to erect an approx. 20′ x 20′ garage with breezeway at side of house. To be used for garage on my property located at 536 Oakhurst Ave. between Oakhurst Ave. Spring Garden Drive and Parkway; Lot No. pt. 4, pt.3-5, Section No. 945 or County Map 27, Parcel No. 169 (Zoning: R-1). REASON FOR REFUSAL: Sec. 44 – 88 Lands, usable open space; parking. (a) Front yard. For every lot in a residential district abutting on a street, front yards of the following minimum depth shall be provided: Residence District Minimum Depth R-1 40 feet (c) Rear yards. For every principal building in a residence district, rear yards of the following average depths shall be provided: Residence District Minimum Depth R-1 40 feet Sec. 44-90 (b)Accessory structures. (2) No accessory structure shall be allowed in a front yard except as a variance by the board of adjustment. A public hearing will be held in the Board of Directors Room, the New Municipal Complex at 200 Rogers Street, Bluefield, West Virginia on Thursday, November 17 at 4:30 pm.
