TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 26, 2011, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 19392236, in Book No. 1415, at Page 522, Benjamin J. Young did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated January 5, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Branch Banking and Trust Company to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on
September 18, 2015
at 1:00 PM
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Clearview District, Ohio County, West Virginia, and more particularly described as follows:
The parcel of real estate known as Lot No. 4 of part of the Ralph C. and Catherine Wagner property near Clearview, Richland District, Ohio County, West Virginia, a better description of which is as follows:

Beginning for the same on the south side of the Reilly and Delaplane Road, corner to Lots Nos. 4 and 5 as shown on the map of part of The Ralph C. and Catherine Wagner Property as surveyed by Walter Stegman, a Registered Engineer, of Wheeling, West Virginia. The above mentioned corner is also located 20 feet measured at right angles with the center line of the above mentioned road; thence along the southerly side of said road and with the northerly line of Lot No. 4 N. 67* 47′ E. 50 feet to the corner of Lots Nos. 3 and 4; thence leaving the side of said road in a southerly direction and along the division line of Lots Nos. 3 and 4 S. 22* 13′ E. 412.53 feet to the southeasterly corner of said Lot No. 4; thence leaving said division line in a southwesterly direction along the southerly line of Lot No. 4 S. 54* 02′ W. 51.48 feet to the southwesterly corner of Lot No. 4, and also a corner of Lot no. 5 as shown on the above mentioned map; thence in a northerly direction along the division line of Lots Nos. 4 and 5 N. 22* 13′ W. 424.77 feet to the place of beginning containing 481/1000 acres, more or less, and being Lot No. 4 on a map of the subdivision aforesaid.

There is excepted from this conveyance all the coal (underlying the land aforesaid) heretofore conveyed to W.M. Dunlap by Townsend C. Adams and others by deed dated the 28th day of November, 1900, and recorded in the aforesaid County Clerk’s Office in Deed Book No. 104, page 127.

This conveyance is subject to the right-of-way given the Chesapeake and Potomac Telephone Company of West Virginia by Linnie Huntsberry dated the 8th day of August, 1939, and recorded in said Clerk’s office in Deed Book No. 256, at page 102.

Subject to all covenants and agreements as contained in the conveyance by Albert A. Huntsberry and Linnie J. Huntsberry, his wife, to the Board of Commissioners of the County of Ohio for a forty (40) foot right-of-way on the Reilly and Delaplane Road measured twenty (20) feet from the center line of said road by deed dated the 20th day of May, 1930, and recorded in the said County Clerk’s office in Deed Book No. 222, at page 383.

The said party of the second part hereby covenants and agrees for himself, his heirs, executors, administrators, and assigns with the said parties of the first part, their successors and assigns that any principal structure of dwelling house erected upon the property hereinabove described and conveyed shall cost not less than the sum of Five Thousand Dollars ($5,000.00); that no principal structure or dwelling shall come closer than forty (40) feet to the front line of said lot hereby conveyed, excepting an open porch, piazza or stoop; that all sewerage is to be taken care of by septic tank sewerage and no open sewers.

Being the same property which was heretofore conveyed to Benjamin J. Young, by Melvin E. Larese, by Deed dated the 26th day of May, 2011, and recorded in the aforesaid County Clerk’s Office in Deed Book No. 822, at page 343.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 180 Clearview Ave, Wheeling, WV 26003.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $6,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
