NOTICE OF TRUSTEEáS SALE

 

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, by that certain Deed of Trust dated July 15, 2010, executed by Borrower(s), Eric B. Strawderman, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1611, at Page 891. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2041 Lake Washington Road, Washington, WV 26181. The borrower(s) defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

 

June 16th, 2016 at 5:37 P.M.

 

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Lubeck District, Wood County, West Virginia, and being more particularly described as follows:

 

Situated in the State of West Virginia, County of Wood and in the District of Lubeck. FIRST TRACT:

 

BEGINNING at a point in the south right of way line of said road, said point bearing N. 60õ 30á W. 50 feet from where the eastern boundary line of a tract of land containing 43.2 acres now belonging to Denver Allen and Ernestine Allen intersects the right of way line of said Washington Bottom Read; thence S 6õ 30á E. 352 feet to a stake, said line being 50 feet from and parallel to the above mentioned easterly boundary line of the 43.2 acre tract of land belonging to said Denver and Ernestine Allen; thence N. 72õ 40á W. 282 feet to a stake; thence N. 33õ E. 279 feet to a stake at the brow of a hill; thence N. 31õ 40á E.109.75 feet to a stake in the south right of way line of said Washington Bottom Read; thence with the line of said road S. 61õ 30á E. 123.7 feet to the beginning, containing 1.7 acres, more or less.

 

There is EXCEPTED and hereby NOT CONVEYED the following:

 

BEGINNING at a point in the southerly line of Washington Bottom Road at the northeast corner of the Patterson 1.70 acre parcel (Deed Book 841, at page 455); thence S. 6õ 30á W. and with the easterly line of said 1.70 acre parcel 352 feet to its southeast corner; thence N. 71õ 56á W. 15 feet to a point; thence N. 6õ 30á E.355 feet, more or less, to a point in the southerly line of Washington Bottom Road; thence S. 61õ 10á E. and with said southerly line 15 feet, more or less, to the place of beginning, containing 5300 square feet, 0.121 acre, more or less.

 

However, there is expressly excepted and reserved from this conveyance, one-half of all the royalty from the oil, gas and other minerals lying in and under the above-described and herein conveyed tract of land, the same having been excepted and reserved in a deed conveying a larger tract or parcel of land, which includes the tract or parcel of land hereby conveyed, executed by L.E. Gilliand and wife, dated the 30th day of April, 1921, and of record in the Office of the aforesaid Clerk, in Deed Book 178, at page 498.

 

The parties hereto believe the acreage of the First Tract to be 1.579 acres, more or less.

SECOND TRACT:

 

BEGINNING at a point in the southerly line of the Patterson, now Hyde, 1.70 acre parcel (Deed Book 841, at page 445), said point being N. 71õ 56á W. 15 feet from the southeast corner of said parcel; thence N. 71õ 56á W. and with the southerly line of said 1.70 acre parcel, 267 feet to the southwest corner of said parcel; thence S. 27õ 05á W. 15 feet to a point; thence S. 71õ 56á E. 273 feet, more or less, to a point; thence N. 6õ 30á E. 15 feet, more or less, to the place of beginning, containing 4050 square feet, 0.93 acre, more or less.

Being the same property conveyed to Eric B. Strawderman by the Deed dated July 15, 2010 and recorded in Deed Book 1156 at Page 30 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

 

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.

 

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

 

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

 

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

 

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
