ORDER OF PUBLICATION
Based upon the Affidavit of George Zivkovich, Counsel for Petitioner, the Court does find as follows:
The title of the civil action is set forth above. The object of this civil action is to allow the Parkersburg Utility Board to obtain a right-of-way and also a temporary construction easement and temporary access roadway over and across real property contained in Deed Book 1053, at Page 768 in the Office of the Clerk of the County Commission of Wood County, West Virginia, being part of the same real estate conveyed to MICHAEL SCHNEIDER, Grantee, from JAMES A. STANLEY, Grantor, by deed dated August 5, 2002. Michael Schneider died on August 14, 2014, a resident of Wood County, West Virginia. An Appraisement was filed on January 28, 2015, which listed the following children as his heirs: Nellie Corns, Jeremy Koehler,
Caitlin Schneider, and Zachariah Schneider. The undersigned was able to ascertain outside the records contained in the Wood County Court House that Michael Schneider also had a child, Jacob Schneider, a minor, as well.
The name and address of Petitionerás attorney is as follows: George Zivkovich, 515 Market Street, P. O. Box 166, Parkersburg, WV 26102. A copy of the Petition may be obtained from the Office of the Circuit Clerk of Wood County, West Virginia, located at No. 2 Government Square, 1st Floor, Parkersburg, West Virginia 26101. The unnamed and unknown heirs of Michael Schneider must appear and defend on or before thirty (30) days from the date of first publication. Otherwise, judgment by default may be rendered against them at any time thereafter.
It is ORDERED that, for good cause shown, service may be effected upon said defendants by publication of this Order in the Parkersburg News and Sentinel once a week for two (2) consecutive weeks as provided by Rule 4(e)(1)(C)and (E) of the West Virginia Rules of Civil Procedure.
