NOTICE OF SALE
UNDER DEED OF TRUST
Notice is hereby given that, under authority of a
certain deed of trust hereinafter described, the undersigned Substitute Trustee will, at the front door of the Randolph
County Courthouse, in Elkins, West Virginia, on
September 4, 2024
11:00 a.m.
offer for sale certain property described in that certain deed of trust executed by PHILIP C. FIRL and CARLEEN F. FIRL to JENNIFER L. MORGAN and MATTHEW E. OSBORNE, as Trustees, which deed of trust is dated the 21st day of January, 2015, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 531, at Page 592, and further re-recorded in Trust Deed Book 532, at Page 427; and given to secure CITIZENS BANK OF WEST VIRGINIA, the payment of a note therein described, and which said property is described as follows: all that parcel or tract of real estate, containing 3.04 acres, more or less, situate in the New Interest District, Randolph County, West Virginia, being about 1.3 miles north of Montrose and lying north of County Route 1 and being more particularly bounded and described as follows:
Beginning at a fence corner, on the eastern bounds of a 20.00 ft. wide right of way, about 125 ft. north of County Route 1, set a steel rod at the base, thence with two new lines of division thru Ware N 29-18-55 E 210.27 ft. to a point on said bounds, set a steel rod; thence, leaving said bounds N 79-30-52 E 313.26 ft. to a found steel rod in a drain, corner to Hartman; thence, with Hartman and said drain for eight lines S 14-54-57 W 28.59 ft. to a found steel rod; thence, S 8-29-00 E 51.41 ft. to a point; thence S 48-20-00 E 20.15 ft. to a point; thence, S 8-26-00 W 20.06 ft. to a point; thence, S 1-43-00 W 14.46 ft. to a point; thence, S 22-44-00 E 35.36 ft. to a point; thence, S 70-42-00 E 10.35 ft. to a point; thence, N 60-34-00 E 20.52 ft. to a found steel rod; thence, leaving said drain and with Hartman for one line in part; S 25-50-27 E 319.80 ft. to a point; set a steel rod from which a found steel rod bears S 25- 50-27 E 20.39 ft.; thence, with two more new lines of division thru Ware N 71-42-45 W 413.79 ft. to a point, set a steel rod; thence, N 71-16-09 W 221.04 ft. to the beginning containing 3.04 acres, more or less, as surveyed by James T. Carr P.S. %23920 in May 1995, and as shown on that Plat of Survey for Philip & Carleen Firl, attached to that deed from Ware to Firl, dated June 22, 1995, of record in the aforesaid Clerk’s Office in Deed Book 439, at Page 716.
There is further conveyed a 1996 FTWD FH doublewide mobile home, VIN NO: NCFLS69ABC10990LS13.
And being the same tract or parcel of real estate conveyed to Philip C. Firl and Carleen F. Firl, by virtue of a deed from Mary A. Ware, dated June 22, 1995, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 439 at Page 716. Subsequently, Philip Charles Firl died October 24, 2019, and pursuant to the survivorship language in the above-described deed, title vested solely in Carleen Fay Firl. This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate. The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.
TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”. The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
