NOTICE

Notice is hereby given that the above-styled matter has been filed in the Circuit Court of Wood County, West Virginia, pursuant to the West Virginia Contraband Forfeiture Act (West Virginia Code 60A-7-701, et. seq.). Any person or corporation having a claim to the hereinafter described property shall, on or before the 2nd day of October, 2024 file, in writing, their claim to said property with the Clerk of said Court, which said claim must clearly state the identity of the claimant and an address where legal process can be served upon such person or corporation. A copy of said claim shall be delivered to Patrick O. Lefebure, Prosecuting Attorney, Counsel for Petitioners, at the Office of the Wood County Prosecuting Attorney, Judge Donald Black Annex, 317 Market Street, Parkersburg, West Virginia 26101.

Pursuant to West Virginia Code 60A-7-705 (c)(1-6), the following information is given: (1) the property seized which is the subject of the petition filed is $1,258.00 IN UNITED STATES CURRENCY, TAURUS 9MM PISTOL, S/N ACH142937 and TAURUS REVOLVER, MODEL 942 UL, S/N AEE415724; (2) the Parkersburg Police Department is responsible for the seizure; (3) the property was seized on May 28, 2024 at 1401 Staunton Avenue, Parkersburg, Wood County West Virginia; (4) the only owners of the property subject to forfeiture known to Petitioners is Eric Swihart, whose address is 27830 State Route 7, Marietta, Ohio, Brian Madison, whose address is 1017 George Street, Parkersburg, West Virginia and/or Amy Henderson, whose address is 2552 Slate Run Road, Belleville, West Virginia; (5) the person having possession of the seized property at the time of the seizure was Eric Swihart, Brian Madison and/or Amy Henderson; and (6) a request to the above named Court to enter an Order directing ownership of said property in the State and the Parkersburg Police Department will be made.
