The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 22, 2021, and duly recorded in the Office of the Clerk of the County Commission of Preston County, West Virginia, in Document No. 21616830, in Book No. 632, at Page 417 and re-recorded in Document No. 21625722 (MOD), in Book No. 646, at Page 413, Kenneth Jacques and Angelica Jacques did convey unto Jenkins Fenstermaker, PLLC, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Vanderbilt Mortgage and Finance, Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Preston County Courthouse in Kingwood, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 10 – Grant District, Preston County, West Virginia, and more particularly described as follows:
All that certain tract or parcel of real estate situate in Grant District, Preston County, West Virginia, lying along the western side of County Route 8/3, approximately 250 feet south if its intersection with County Route 8/2, and being more particularly described as follows:
BEGINNING at an iron rebar (set), on the western side of County Route 8/3, corner to David E. and Sharon L. Hall (494/936), from which a utility pole bears S. 81 deg 50′ 45″ E. 1 foot, said rebar also being the northeastern end of a proposed, 20 foot wide right-of-way hereinafter described, thence with the western side of County Route 8/3, 15 feet from center, for two lines S. 15 deg 29′ 05″ W. at approximately 20 feet leaving said proposed right-of-way, in all 80.71 feet to a point, thence S. 16 deg 40′ 22″ W. 631.63 feet to an iron rebar (set), on the western side of County Route 8/3, corner to Marlene K. White (501/343), thence with White N. 59 deg 36′ 57″ W. 361.50 feet to an iron rebar (set), corner to White, thence with a new division line of Donald E. and Sylvia Summers (373/21, Third Tract) for one line and part of another N. 33 deg 20′ 27″ E. at approximately 607 feet passing the western end of said proposed right-of-way, in all 627.61 feet to an iron rebar (set), thence with the northern side of the proposed right-of-way S. 81 deg 50′ 45″ E. at 11.00 feet passing a fence corner post, corner to said Hall, and continuing with hall, in all 171.40 feet to the point of beginning, containing 4.00 acres, more or less, as surveyed in September, 2011, by James Bruce David, WVPS #796, and as shown on a plat recorded in Deed Book 738 at Page 683.
There is excepted and reserved from this conveyance the joint, appurtenant right to the use of that certain proposed 20 foot wide right-of-way, over and across the 4.00 acre lot herein described, along then northern line of same, as shown on said plat, more particularly described as follows:
BEGINNING at an iron rebar (set), also the beginning corner of the 4.00 acre lot herein described, thence with the western side of County Route 8/3 S. 15 deg 29′ 05″ W. approximately 20 feet to a point, thence leaving the County Road and running parallel to, and 20 feet south of Hall’s line N. 81 deg 50′ 45″ W. to a point in the western line of the 4.00 acre lot, thence with the western line N. 33 deg 20′ 27″ E. approximately 20 feet to an iron rebar (set), thence S. 81 deg 50′ 45″ E. at 11.00 feet passing Hall’s fence post and continuing with Hall’s line, in all 171.40 feet to the beginning, said right-of-way being for the joint use and benefit of predecessors in title, Donald E. Summers and Sylvia J. Summers, their heirs, successors and assigns, and Kathleen S. Jean, her heirs, successors, and assigns, including the Grantees herein for purposes of ingress, egress and regress to and from the real estate herein conveyed and other real estate owned by the Grantors in Deed Book 738 and Page 680 and West Virginia County Route 8/3.
Being the same real estate conveyed unto Kathleen S. Jean by Donald E. Summers and Sylvia J. Summers, husband and wife, by Deed dated October 6, 2011, and recorded in the Office of the Clerk of the County Commission of Preston County, West Virginia in Deed Book 738 at Page 680.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4 Forky Farm Road, Bruceton Mills, WV 26525.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
